f ',-.,,. f ~~ ~~ CITY OF NORTH OLMSTED ORDINANCE NO. 91-47 BY RON TALLON AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CITY OF FAIRVIEW PARK RE- GARDING CAPITAL CHARGES FOR SEWER IMPROVEMENTS. WHEREAS, the City of North Olmsted has an operating agreement with the City of Fairview Park which originates back to the time that the Village of Parkview negotiated a contract with North Olmsted for the providing of service to its residences; and WHEREAS, the aforesaid agreement dated April 3, 1962 provided that certain cost adjustments for capital improvements be made upon the termination of said agreement; and WHEREAS, it is the desire of both the City of Fairview Park, who is a successor to the Village of Parkview, to enter into a new operating agreement to provide for the payment of past cost adjustments as well as future cost shanng; and WHEREAS, this Council deems it in the best interest of the City to enter into the agreement which is attached hereto and marked Exhibit "A". NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an agreement with the City of Fairview Park providing for the sharing of costs for the Service Area within the City of Fairview Park serviced by the City of North Olmsted which agreement is attached hereto and marked Exhibit "A". SECTION 2: That this ordinance hereby repeals any ordinance or parts of any ordi- nance inconsistent herewith.
