CITY OF NORTH OLMSTED ORDINANCE N0.2011-11 BY: Council President Limpert and Council Member Brossard AN ORDINANCE AMENDING THE TRAFFIC CONTROL FILE OF THE CITY OF NORTH OLMSTED TO PROVIDE FOR THE INSTALLATION AND ENFORCEMENT OF ADDITIONAL "NO PARKING" SIGNS ON THE FIRE HYDRANT SIDE OF PHEASANTS WALK NORTH OF THE INTERSECTION OF LORAIN ROAD. WHEREAS, the City Engineer and the Director of Public Safety, following study and review, have found and determined that a safety and enforcement issue exists on Pheasants Walk Drive, north of the intersection of Lorain Road, as a result of automobile parking on the fire hydrant side of the street at said location, in violation of City ordinances, and which interferes with vehicular traffic in the vicinity; and WHEREAS, the City of North Olmsted has enacted citywide prohibition of parking on the fire hydrant side of residential streets but the signage is primarily located at and limited to major roadways, visible upon entering the geographic limits of the City, in accordance with law, and without additional signage required on individual City streets; and WHEREAS, as a practical consequence of the legal signage for citywide parking prohibitions, motorists parking on Pheasants Walk to visit Chambers Funeral Home may not recognize the parking restriction without additional signage proposed herein; and WHEREAS, this Council, based upon those findings and expert opinions, has determined that it is in the best interest of the safety, health and welfare of the citizens of the City of North Olmsted to install additional signs to "No Parking" signs to prohibit parking on the fire hydrant side of Pheasants Walk, and accordingly, by the adoption of this Ordinance, desires to do so; and WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of the Traffic Control File, which file can be amended only by Ordinance duly adopted by this Council; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND THE STATE OF OHIO: SECTION 1: That the Police Department be and is hereby authorized and directed to amend the Traffic Control File of the City of North Olmsted to indicate thereon the installation of "No Parking" (sign R7-1 of the OMUTCD 2005, Section 2B.39-2B.41) with directional arrow and, upon approval of the City Engineer, supplemental plaque notation "Fire Hydrant Side" in order to provide additional warning of the citywide prohibition against parking on the fire hydrant side of all streets. SECTION 2: That the Mayor be and is hereby authorized to cause an appropriate sign or signs to be installed on Pheasants Walk Drive in accordance with the provisions of this Ordinance and the Ohio Manual of Uniform Traffic Control Devices.
