wt CITY OF NORTH OLMSTED ORDINANCE N0.2011 - 15 BY: Mayor Kennedy AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 149 OF THE ADMINISTRATIVE CODE ENTITLED "PLANNING AND DESIGN COMMISSION" IN ORDER TO CREATE THE POSITION OF VICE CHAIRMAN, TO ELIMINATE REFERENCE TO THE CLERK OF COMMISSIONS ACTING AS SECRETARY TO THE BOARD AND TO AMEND THE NOTICE PROVISION FOR HOMEOWNERS ASSOCIATIONS, AS AMENDED . WHEREAS, for the purpose of efficiency and to ensure the smooth operation of business before the Commission, it is the recommendation of the Administration that the Planning and Design Commission be permitted to create the position of Vice Chairman to act in the absence of the Chairman; and WHEREAS, it is the recommendation of the Administration that reference to the Clerk of Commissions as recording secretary be abolished as redundant; and WHEREAS, the notice provisions for the condominium association should include a reference to service upon the agent for service of process as listed in the filings of the Ohio Secretary of State; and WHEREAS, it is the desire of this Council, consistent with the recommendations of the Administration, to create the position of Vice Chairman, to remove reference to the Clerk of Commissions as recording secretary and to provide for notices to be served upon the agent as identified in documents recorded with the Secretary of State. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Chapter 149 "Planning and Design Commission" which presently reads in its entirety as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in Exhibit B, which is likewise attached to this Ordinance and likewise incorporated by reference as if fully rewritten herein. SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or inconsistent provisions of any Ordinance shall be corrected at re-codification. SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law.
