CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2012 - 5 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 941 <br />OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE <br />ENTITLED "REFUSE COLLECTION" IN ORDER TO IMPLEMENT NEW <br />STANDARDS FOR REFUSE COLLECTION WITHIN THE CITY OF <br />NOR TH OLMSTED, AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the City of North Olmsted in the spring of 2011 phased in a new and revised <br />system of refuse collection by and through the use of automated collection; and <br />PVHEREAS, as a result of the new automated process, the procedures previously autlined <br />in Chapter 941 are outdated and obsolete; and <br />WHEREAS, it is the recommendation of the Administration that the City fully transition <br />to the new and revised automated system; <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration, to establish refuse collection criteria delineating, ainong other things, standards <br />? for collection and further establishing criteria necessary to obtain service within the City. <br />? <br />NOW THEREFORE,I3E IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 941 "Refuse Collection" which presently reads in its entirety <br />as set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if <br />fully rewritten herein, shall be amended and, as amended, shall read in its entirety as set forth in <br />Exhibit B, which is likewise attached to this Ordinance and likewise incorparated by reference as <br />if fully rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re-codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately in order to have <br />in place clear criteria establishin}; the basis for who is entitled to receive city-provided refuse <br />removal services; and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor.
