CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2012 - 38 <br />BY: Mayor Kennedy <br />AN ORDINANCE ABOLISHING CHAPTER 949 OF THE STREETS, <br />UTILITIES AND PUBLIC SERVICES CODE OF THE CITY OF NORTH <br />OLMSTED ENTITLED "TREES AND WEEDS" AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, a comprehensive re-write of the property maintenance ordinances of the <br />City of North Olmsted includes, among other things, consolidation of obligations into one <br />location of the codified ordinances; and <br />WHEREAS, it is the recommendation of the Administration that Chapter 949 of the <br />Streets, Utilities and Public Services Code of the City of North Olmsted be abolished and <br />consolidated into a new and revised Chapter 1363 of the Building Code of the City of North <br />Olmsted entitled "Property Maintenance," and <br />WHEREAS, Ordinances 64-211, 78-87, 2003-98 and 2008-156 collectively created <br />Chapter 949 of the Streets, Utilities and Public Services Code entitled "Trees and Weeds," and <br />WHEREAS, consistent with the recommendation of the Mayor, it is the desire of this <br />Council to abolish and eliminate Chapter 949 from the Building Code. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 949 of the Building Code established via ordinances 64-21 l, <br />78-87, 2003-98 and 2008-156 (collectively know as Chapter 949 of the Streets, Utilities and <br />Public Services Code) be, and the same hereby is abolished, repealed, void and of no effect. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Ordinance go into effect immediately so as to permit <br />prompt, clear and efficient enforcement of property maintenance in the City of North Olmsted, <br />and further provided it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: ?-- <br />i <br />First Reading: 3 JN d- <br />Second Reading: <br />Third Reading: <br />Committee: ? 2 -0
