CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2012 - 69 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO MAKE <br />SUPPLEMENTAL DESIGN LOAN APPLICATION FOR A <br />SUPPLEMENTAL WATER POLLUTION CONTROL LOAN FUND <br />AGREEMENT ON BEHALF OF THE CITY OF NORTH OLMSTED FOR <br />PLANNING, DESIGN, AND / OR CONSTRUCTION OF WASTE WATER <br />FACILITIES; AND FURTHER AUTHORIZING THE MAYOR TO ENTER <br />INTO THE SUPPLE1l1ENTAL AGREEMENT IF THE APPLICATION IS <br />ACCEPTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted seeks to upgrade its existing wastewater and <br />collection facilities; and <br />WHEREAS, the City of North Olmsted applied for (and received) Water Pollution <br />Control Loan Funds (WPCLF) for the planning, design, and / or construction of the wastewater <br />facilities, including plan upgrades and improvements to the collection system; and <br />WHEREAS, additional necessary work has been recommended by way of a Chapel Hill <br />relief sewer and an increase of the previous equalization basin design size and configuration at <br />the Dover Pump Station; and <br />WHEREAS, the Ohio Water Pollution Control Loan Fund requires the City of North <br />Ulmsted to enact additional legislation for the supplemental design loan application and the <br />execution of a supplemental agreement; and <br />WHEREAS, the City has already established, by previous ordinance, the "User Revenue <br />Account" from which repayment shall take place. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CDUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to apply for a supplemental <br />/ revised WPCLF design loan; and does further authorize the Mayor to execute a supplemental <br />contract and any and all other papers necessarily required by the WPCLF including, but not <br />limited to, a Water Pollution Control Loan Fund agreement with the Ohio Environmental <br />Protection Agency and the Ohio Water Development Authority for the planning, design and / or <br />construction of wastewater facilities on behalf of the City of North Olmsted. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />may make a timely application with the State of Ohio for participation and timely bidding; and <br />further, provided it receives the affirmative vote of two-thirds of all members of the Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: ?C ? <)-D 1 d-- First Reading: ?
