CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2013 - 52 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 1101 OF THE ZONING CODE OF <br />THE CITY OF NORTH OLMSTED ENTITLED "SUBDIVISION <br />REGULATIONS" FOR THE PURPOSE OF CLARIFYING REQUIRED <br />DEPOSITS. <br />WHEREAS, the Zoning Code Section 1101.05, 1101.06 and 1101.09 establish the <br />procedure and deposits required for subdivisions; and <br />WHEREAS, the Director of Planning and Development recommend amendment of the <br />Zoning Code to update the and adjust longstanding deposit structures; and <br />WHEREAS, the Planning and Desi ' sion on the day of <br />, 2013, by formal motion, recommended '- did not recommend) that this <br />Ordinance, proposing to amend the Zoning Co ity of North Olmsted as set forth <br />herein, be adopted; and <br />1%aw WHEREAS, following publication of newspaper notice, a public hearing was held, in <br />conformance with the provisior,?of Section 14 of Article IV of the Charter and Section 1127.03 <br />of the Zoning Code, on the ? day of ,o , , 2013. <br />WHEREAS, it is the desire of this Council to amend Section 1101.05, 1101.06, 1101.09 <br />of the Zoning Code of the City of North Olmsted, in connection with processing of subdivision <br />submittals, to provide a new and revised deposit structure. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1101.05, 1101.06 and 1101.09 which currently read as <br />follows: <br />1101.05 RECORDING AND REVIEW FEES FOR MAJOR SUBDIVISIONS. <br />(a) A deposit shall be posted with the City by the developer for the recording of <br />subdivision plats, easements, etc., the review of the preliminary plan, topographic map, plat and, <br />if the improvements are to be completed by the developer, improvement plans and specifications <br />before the matter is referred to the Engineer-or Law Director. The cost of review shall be <br />calculated on the basis of thirty-five dollars ($35.00) per hour spent by the City Engineer's Office <br />and fifty-five dollars ($55.00) per hour spent by the City Engineer and the Assistant City <br />Engineer for such review. If the deposit is more than the actual cost of review, the remainder <br />shall be refunded. If the cost of recording and review is greater than the deposit, the deficient <br />amount shall be paid to the City before Council approval is given.
