....?_..??.??..,,..,Ad... ,??.,..?,..?..?,?,,,.....???.?, __. ?.....?„?.?..,..,.??_? .a?MV...w?.??.. .._ .. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 -172 <br />BY: Mayor O'Grady <br />AN ORDINANCE A UTHORIZING THE DIRECTOR OF LA W TO <br />ENTER INTO A SETTLEMENT AGREEMENT WITH VIKING <br />INSURANCE IN ORDER TO ACCEPT PAYMENT FOR PROPERTY <br />DAMAGE AND AUTHORIZING THE MAYOR TO EXECUTE A <br />RELEASE OF PROPERTY CLAIMS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, on March 27, 2006, a motor vehicle operated by Charles Davis <br />collided with a police cruiser operated by Patrolman Daryl Longley on I-480 near Barton, <br />causing substantial property damage; and <br />WHEREAS, Charles Davis' insurance company, Viking Insurance, offered the <br />City insurance limits in the amount of Seven Thousand Five Hundred ($7,500.00) Dollars <br />in exchange for a release of property claims by the City; and <br />WHEREAS, the 2003 police cruiser was scheduled for trade-in or auction in <br />conjunction with the new police cruisers being purchased and, therefore, the Viking <br />Insurance offer of policy limits would reasonably and fully satisfy the City's property <br />damage claim; and <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Director of Law be and he is hereby authorized, in <br />accordance with North Olmsted Codified Section 137.03(C), to settle the City's property <br />damage claim with Viking Insurance in the amount of Seven Thousand Five HundrecA- <br />($7,500.00) Dollars and further to authorize the Mayor to execute a Release of property <br />claims on behalf of the City and against Charles Davis, in substantially the form as <br />attached hereto as Exhibit A, as full and final settlement for property damages that <br />occurred in an automobile accident on March 27, 2006 on I-480 at Barton Road. A copy <br />of the Release is attached hereto as Exhibit A. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that it is necessary that this Ordinance go into effect immediately so that <br />the City may obtain a lump sum payment from Viking Insurance for damages to its police <br />cruiser, and further provided it receives the affirmative vote of two-thirds of all members <br />of Council, it shall take effect and be in force immediately upon its passage and approval <br />by the Mayor.
