Ordinance No. 786 <br />By Mr. Baumgardner <br />AN ORDINAIvCE <br />DETEBMINING T0 PROCEED WITH 3'HE IMPROVIIbiFNT OF SILVMDALE HOAD, <br />FRlJM IARAIN ftOAD TO 2Hr, NORTH LINE OF SUB?AT N0. 2% BY CONSTRUCTIAIG <br />THEREIN A WATER LINE. <br />BE IT ORDAINED by the Council of the Village of North 07.msted, <br />State of Ohio: <br />Section 1. That it is hereby determined to proceed with the <br />improvement of Silverdale Rao d, from Lorain Road to the North Line <br />of Sublot No. 29., by constructing therein a water line, in accordance <br />with Resolution No. 1570, passed on the 2nd day of August, 1949, and <br />in accordance with the plans, specifications, estimates and profiles <br />heretofore approved and now on file in tihe office of the Clerk. <br />Section 2. That all claims for damages resulting therefrom shall <br />be judicially inquired into after the completion of the pmposed improve- <br />ment, and the solicitor be, and he is hereby, authorized and directed <br />to institute proceedings in a court of competent jurisdiction to inquire <br />into such claims. <br />Section 3. That the cost of said improvemnt sha11 be assessed by <br />the foot front upon the fQl].owing described lots and lands, to wit, all <br />lots and lands bounding and abutting upom the proposed improvement, which <br />said lots and lands are hereby determined to be specially benefited by <br />said improvement; and the cost of said improvement shall include the <br />pcpense of preliminary and other surveys, of printing.and publishing <br />the notices., reaolutions and ordinances required., t he serving of said <br />notices, the cost of construction, together with interest on notes or <br />bonds issued in anticipation of collection of deferred assessments and <br />all other necessary expendi.tures. <br />Section 4. That the assessments so to be levied shall be paid in <br />ten annual installments, with interest not to exceed six per cent per annum <br />on deferred payments, provided that the owner of any property assessed may, <br />at his option, pay such assessment in cash within thirty days from and after <br />the passage of t he assessing orciinance, in Khich case said assessment shall <br />not include ar?y item of inter t upon notes or bonds to be issued in antici- <br />pation of the collection of dferred i.nstallments of assessments. <br />Section 5. That notes or bonds of the Village of North Olmsted <br />shall be issued in anticipation of the co llection of assessments by install- <br />ments and in an amAUnt equal thereto. <br />Sgetion 6. That the Clerk be., and he is hereby, authorized and d irected <br />to advertise for bids for t he construction of said improvement according to <br />Iaw. <br />Section 7. This ordinance is hereby declared to be an emergency <br />n!easure, necessary for the imnediate preservation of public health, peace, safety <br />and welfare, and shall t ake effect arxi be in force fron and after its <br />passage. <br />Passed: December 6, 1949. <br />E.
