CITY OF NORTH OLMSTED <br />RESOLUTION N0.2010 - 1 <br />BY: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO ADVERTISE <br />FOR BIDS FOR A ONE YEAR CONTRACT (WITH AN <br />ADDITIONAL AUTOMATIC ONE YEAR EXTENSION) FOR <br />LABORATORYANALYTICAL SERVICES FOR THE WASTEWATER <br />TREATMENT PLANT, AS PER SPECIFICATIONS ON FILE AND, <br />UPON APPROVAL BY THE BOARD OF CONTROL, FURTHER <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR <br />SAME WITH THE LOWEST AND BEST BIDDER, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the current contract for laboratory analytical services for the <br />Wastewater Treatment Plant expires on March 31, 2010; and <br />WHEREAS, plans and specifications for a new contract for said services required <br />by the City's NPDES Permit have been prepared by the Wastewater Treatment Plant <br />Superintendent and are on file in the office of the Director of Public Service; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to advertise for <br />bids for said new contract in accordance with said plans and specifications, and for the <br />Mayor, upon approval of the Board of Control, to enter into a contract for said laboratory <br />analytical services with the lowest and best bidder. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to advertise for bids for a <br />contract for laboratory analytical services for the Wastewater Treatment Plant for a one <br />year term with provision for an automatic extension of an additional one year term unless <br />either party provides notice to the other within 120 days of the end of the first one year <br />term, in accordance with the plans and specifications on file in his office; and further that, <br />upon approval by the Board of Control, the Mayor be and is hereby authorized to enter <br />into a contract and execute same on behalf of the City of North Olmsted with the lowest <br />and best bidder. <br />SECTION 2: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare and for the further reason that it is necessary that this Resolution go into effect <br />immediately due to the pressing need for such laboratory analytical services on and after <br />March 31, 2010, which services may be compromised given the length of time necessary <br />to comply with public contract advertising requirements in addition to 30 days otherwise <br />necessary for the Resolution to take effect without an emergency declaration, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
