. <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2010 - 127 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF <br />PLANNING AND DEVELOPMENT TO REQUEST <br />PROPOSALS FOR LANDSCAPE DESIGN AND <br />INSTALLATION SERVICES FOR A CABLE BOX <br />LANDSCAPING PROJECT; FURTHER A UTHORIZING THE <br />MA YOR TO ENTER INTO AN A GREEMENT WITH THE <br />PROPOSAL SELECTED IN THE RFP PROCESS, AFTER <br />APPROVAL BY THE BOARD OF CONTROL, AND <br />DECLARING AN EMER GENCY. <br />WHEREAS, it is the desire of this Council to authorize the Director of Planning <br />and Development to request proposals from consultants for landscape design and <br />installation services related to the Cable Box Landscape Project and, upon approval of the <br />Board of Control, to autharize the Mayor to enter into an agreement with the proposal <br />selected in the RFP process. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Planning and Development be and she hereby <br />is authorized to request proposals (RFP) from landscape professionals for design and <br />installation services related to the Cable Box Landscape Project pursuant to plans on file. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of <br />the Board of Control, to enter into an Agreement with the consultant selected in the <br />Request for Proposal process provided that the proposal does not exceed $25,000.00. <br />That such Agreement be in substantially the same form of Agreement as approved by the <br />Director of Law, with only such changes to be hereinafter made as are not substantially <br />adverse to the City and which are approved by the Director of Law. The character of any <br />such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Agreement by the Director of Law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare <br />of this City, and for the further reason that this Resolution is required to be immediately <br />effective to enable the City to expedite the RFP process during the fall planting season, <br />when material prices may be more reasonable; and further provided that it receives the
