CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2010 - 130 <br />BY: Mayor Kennedy <br />AN ORDINANCE ABOLISHING CHAPTER 1361 OF THE BUILDING <br />CODE OF THE CITY OF NORTH OLMSTED ENTITLED "FLOOD <br />DAMAGE PREVENTIDN" AND FURTHER ESTABLISHING A NEW AND <br />REVISED CHAPTER 1361 OF THE BUILDING CODE OF THE CITY OF <br />NORTH OLMSTED, ENTITLED "FLOOD DAMAGE PREVENTION" IN <br />ORDER TO COMPORT WITH REQUIREMENTS OF THE OHIO <br />DEPARTMENT OF NATURAL RESOURCES, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Ord. 92-60 of the Codified Ordinances of the City of North Olmsted created <br />a new Chapter 1361 of the Building Code entitled "Flood Damage Prevention"; and <br />WHEREAS, from time to time State and Federal regulations are amended thereby <br />requiring the City of North Olmsted to amend its code in order to be in compliance with State <br />and Federal statutes and regulations concerning, among other things, flood damage prevention; <br />and <br />WHEREAS, the current draft of Ohio Department of Natural Resources Flood Damage <br />Prevention measures constitutes a comprehensive re-write of flood damage prevention measures <br />currently in effect in the City of North Olmsted, such that amendment, in lieu of repeal, is not <br />feasible; and <br />WHEREAS, in order to be in compliance with State and Federal law, it is necessary to <br />eliminate the current Chapter 1361 of the Codified Ordinances and to enact a replacement <br />Chapter 1361 of the Codified Ordinances. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Ord. 92-60, establishing Chapter 1361 of the Building Code of the <br />City of North Olmsted ("Flood Damage Prevention"), be, and the same hereby is, repealed, void <br />and of no effect. r <br />SECTION 2: That there is hereby created new Chapter 1361 of the Building Code of the <br />City of North Olmsted, entitled "Flood Darnage Prevention," which, as created, shall read in its <br />entirety as provided for in attached Exhibit A, which is by reference expressly incorporated <br />herein. <br />SECTION 3: That, if any section, paragraph, sentence, clause, phrase, term, provision or <br />part of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid or
