CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2010 - 138 <br />BY: Mayar Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO A <br />CONTRACT WITH ABC PIPING CO., INC. FOR THE PURPOSE OF <br />REPAIRING STEEL COLUMNS IN THE NATATORIUM AT THE <br />RECREATIONCENTER, AND DECLARINGANEMERGENCY. <br />WHEREAS, upon inspection by the City Engineer, it was determined that six (6) steel <br />columns in the natatorium had corroded and were in need of repair; and <br />WHEREAS, estimating that the repair was less than $25,000.00 ($16,000.00), the <br />Administration solicited and received proposals from three (3) potential vendors, with ABC <br />Piping Co., Inc. submitting the lowest proposal at $9,350.00; and <br />WHEREAS, it is the recommendation of the Administration that the City enter into a <br />contract with ABC Piping Co., Inc. to perform the necessary repairs at the Recreation Center; <br />and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the <br />recommendation of the Administration, to authorize the Mayor to enter into a contract with <br />ABC Piping Co., Inc. to perform said repairs. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a contract <br />with ABC Piping Co., Inc. to repair six (6) steel columns in the natatarium at the Recreation <br />Center. Said contract shall be in substantially the same form and substance as the contract <br />attached hereto as Exhibit A, with only such changes thereto as are not substantially adverse <br />to the City and which are approved by the Director of Law. The character of any such changes <br />as not being substantially adverse to the City shall be evidenced conclusively by the execution <br />of the agreement by the Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately due to the fact <br />that the repairs must be completed before additional loads are placed on the roof with the <br />onset of winter snow; and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor.
