.............~_..~M ..,..a.~,.. _ _ <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 - 58 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 1118.03 OF THE ZONING <br />CODE (BUSINESS AND INDUSTRIAL DISTRICT STANDARDS) IN <br />ORDER TO IMPOSE RESIDENTIAL CONDITIONS AND <br />STANDARDS FOR BUSINESS AND INDUSTRIAL CONDITIONAL <br />USES THAT ARE LOCATED UPON PROPERTY THAT IS <br />CONTIGUOUS TO PROPERTY ZONED FOR RESIDENTIAL USE . <br />WHEREAS, Chapter 1118 of the Zoning Code establishes conditions and <br />standards for conditional uses located upon residential, business and industrial property; <br />and <br />WHEREAS, upon review and in order to protect the health, safety and welfare of <br />residents, this Council finds that several of the standards and conditions imposed upon <br />conditional uses that locate in residential neighborhoods should be imposed upon <br />conditional uses on business and industrial properties that are contiguous to residentially- <br />zoned properties; and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 1118.03 <br />of the Zoning Code so as to impose the standards set forth in paragraphs (a), (b) and (d) <br />of Section 1118.02 upon business and industrial properties that are contiguous to <br />residentially-zoned properties; and <br />WHEREAS, the Planning and Design Commission on the ~ day of <br />~~~1•Lw , 2006, by formal motion, (ree~ee~ded -did not recommend) (with <br />suggested changes) that this Ordinance be adopted; and <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the Charter of the City of North Olmsted anc, <br />Section 1127.03 of the North Olmsted Zoning Code, a public hearing was held on this <br />proposed legislation on the day of , 2006; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION l: That Section 1118.03 of the Zoning Code which presently reads as <br />follows: <br />
