.............~_..~M ..,..a.~,.. _ _ CITY OF NORTH OLMSTED ORDINANCE NO. 2006 - 58 BY: Council Member Gareau AN ORDINANCE AMENDING SECTION 1118.03 OF THE ZONING CODE (BUSINESS AND INDUSTRIAL DISTRICT STANDARDS) IN ORDER TO IMPOSE RESIDENTIAL CONDITIONS AND STANDARDS FOR BUSINESS AND INDUSTRIAL CONDITIONAL USES THAT ARE LOCATED UPON PROPERTY THAT IS CONTIGUOUS TO PROPERTY ZONED FOR RESIDENTIAL USE . WHEREAS, Chapter 1118 of the Zoning Code establishes conditions and standards for conditional uses located upon residential, business and industrial property; and WHEREAS, upon review and in order to protect the health, safety and welfare of residents, this Council finds that several of the standards and conditions imposed upon conditional uses that locate in residential neighborhoods should be imposed upon conditional uses on business and industrial properties that are contiguous to residentially- zoned properties; and WHEREAS, it is accordingly the desire of this Council to amend Section 1118.03 of the Zoning Code so as to impose the standards set forth in paragraphs (a), (b) and (d) of Section 1118.02 upon business and industrial properties that are contiguous to residentially-zoned properties; and WHEREAS, the Planning and Design Commission on the ~ day of ~~~1•Lw , 2006, by formal motion, (ree~ee~ded -did not recommend) (with suggested changes) that this Ordinance be adopted; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter of the City of North Olmsted anc, Section 1127.03 of the North Olmsted Zoning Code, a public hearing was held on this proposed legislation on the day of , 2006; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: SECTION l: That Section 1118.03 of the Zoning Code which presently reads as follows:
