CITY OF NORTH OLMSTED <br />RESOLUTION N0.2006 - 55 <br />BY: Council Members Miller, Ryan, Orlowski, Tallon, Dailey Jones and Barker <br />A RESOLUTION URGING THE OHIO STATE LEGISLATURE TO <br />ENACT LEGISLATION PROVIDING FOR A CRIMINAL PENALTY <br />FOR VIOLATIONS OF THE RESIDENCY REQUIREMENTS <br />CONTAINED IN OHIO REVISED CODE SECTION 2950.031, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Ohio State Legislature has enacted Ohio Revised Code Section <br />2950.031 establishing residency requirements prohibiting persons who have been <br />convicted of certain types of sexually oriented offenses from establishing a residence or <br />occupying residential premises within one thousand (1,000) feet of any school premises; <br />and <br />WHEREAS, the Ohio State Legislature has provided for injunctive relief only <br />against persons for violating the provisions of Section 2950.031, and has not provided <br />any criminal penalty which can be enforced by State and/or local police authorities; and <br />WHEREAS, the Council of the City of North Olmsted has determined that it is in <br />the best interest of the citizens of North Olmsted that such a criminal penalty be <br />established and that this penalty be consistent with State and Federal laws. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Council of the City of North Olmsted strongly urges the <br />State Legislature to act quickly and enact legislation to provide for a criminal penalty for <br />individuals who violate the residency requirements of Section 2950.031 of the Ohio <br />Revised Code. <br />SECTION 2: That the Clerk of Council is hereby directed to forward a copy of <br />this Resolution immediately upon passage and approval to the offices of our <br />representatives in the Ohio State Legislature, to the Chair of the Criminal Justice <br />Committee in the Ohio State Legislature and Governor Robert Taft. <br />SECTION 3: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reason that it is necessary that this legislation go into effect <br />immediately to more effectively protect North Olmsted children from registered sexual <br />offenders living near North Olmsted schools, and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />
