. ~ <br />Yom, <br />BY: Mrs. Saringer <br />CITY OF NORTH OLMSTED, OHIO <br />ORDINANCE N0. 77 - ~` <br />~~,, <br />AN ORDINANCE AUTHORIZING AND DIRECTING <br />THE MAYOR TO ENTER INTO AN AGREEMENT <br />WITH THE CITY OF WESTLAKE FOR THE <br />CONSTRUCTION AND INSTALLATION OF A STORM <br />DRAINAGE CULVERT ON THE EAST SIDE OF <br />CLAGUE ROAD, AND DECLARING AN EMERGENCY <br />WHEREAS, The City of North Olmsted has submitted to the <br />administration and Council of the City of Westlake revised drawings <br />for the construction and installation of a storm water culvert on <br />the east side of Clague Road on the North Olmsted-Westlake Boundary <br />and <br />WHEREAS, this Council, upon the recommendation of the City <br />Engineer, desires to approve the plans and authorize the Mayor to <br />enter into an agreement with the City of Westlake to permit the <br />City of North Olmsted to construct the improvement in the City <br />of Westlake at the City of North Olmsted's expense, and <br />WHEREAS, this Council believes that the construction and <br />installation of the culvert as shown on the plans will alleviate a <br />storm water problem in the City of North Olmsted and the City of <br />Westlake. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to <br />enter into an Agreement with the City of Westlake for the construct- <br />ion and installation of a storm drainage culvert on the East side <br />of Clague Road north of the Westlake-North Olmsted Boundary <br />in accordance with the plans prepared by the city of North Olmsted, <br />a copy of which said Agreement is attached hereto and made apart <br />hereof as though fully rewritten herein and marked Exhibit "A". <br />ATTEST: <br />,,~ ~y~~cl•C/ <br />G~~ <br />Nora T. Hill, Cler of Council <br />PASSED: ,, <br />SECTION 2: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is immediately necessary to correct a drainage problem, and <br />further provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />APPROVED: (p <br />RAL E.
