SHARPE AN ORDINANCE AMENDING SECTION 1133.14 ENTITLED "FINALITY OF BOARD ORDER" OF CHAPTER 1133 ENTITLED "BOARD OF ZONING APPEALS" OF THE ZONING CODE OF THE CITY OF NORTH OLMSTED. WHEREAS, it is the desire of this Council to amend the Zoning Code of the City of North Olmsted to make orders of the Board of Zoning Appeals final without the necessity of further review under certain circumstances as the same relates to non-conforming buildings in a Single Family Residence District. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Section 1133.14 entitled "Finality of Board Order" of the Zoning Code of the City of North Olmsted which now reads: "1133.14 Finality of Board Order Any ruling, determination or order issued by the Board made pursuant to Section 1133.13 hereof shall be final and not subject to further review, however, any ruling, determination or order issued pursuant to Sections 1133.11 or 1133.12 hereof shall become final thirty (30) days after the date thereof unless within said thirty (30) days Council by action as provided in this Chapter reverses, amends, modifies or suspends said ruling, determination or order." be and the same is hereby amended and as amended shall read as follows: "1133.14 Finality of Board Order Any ruling, determination or order issued by the Board made pursuant to Section 1133.13 hereof, shall be final and not subject to further review. However, any ruling, determination or order issued pursuant to Sections 1133.11 or 1133.12 hereof shall become final thirty (30) days after the date thereof unless within said thirty (30) days, Council, by action as provided in this Chapter, reverses, amends, modifies or suspends said ruling, determination or order. All rulings,determinations or orders of this Board under Section 1133.12 pertaining to additions to non-conforming buildings in a Single Family Residence District shall be final and not subject to further review by Council." SECTION 2: That Section 1133.14 as previously adopted by this Council is ere y repealed and any Ordinance or parts of Ordinances in conflict herewith are hereby repealed. .~ SECTION 3: That the Clerk of this Council be ~.~~ she is hereby directe~to cause a notice of a Public Hearing hereon to be given pursuant to the provisions of Section 14 of Article IV of the Charter of this City.
