,, <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 77 - // <br />AN ORDINANCE ACCEPTING AN EASEMENT FROM <br />GREAT NORTHERN PARTNERSHIP FOR STORM SEWERS <br />ON THE EASTERLY SIDE OF RELOCATED STATE ROUTE <br />252 LOCATED WITHIN THE CITY OF NORTH OLMSTED. <br />WHEREAS, A storm sewer system has been incorporated within <br />the design and construction of Relocated State Route 252 and, <br />WHEREAS, the City Engineer has advised the Council that it <br />is in the best interest of the City of North Olmsted to accept <br />an easement with respect to the storm drainage system, and <br />WHEREAS, it is the desire of the City of North Olmsted and <br />the Great Northern Partnership to have the City's rights in said <br />storm drainage system clearly specified and made a matter of <br />record by recording a formal easement, and <br />WHEREAS, this Council deems it to be in the best interest of <br />the City of North Olmsted to accept said Easement: <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement <br />from Great Northern Parthership for the construction and maintenance <br />of a storm drainage system under and on the property described in <br />said Easement which is attached hereto and marked Exhibit "A" and <br />made a part hereof as though fully rewritten herein. <br />SECTION 2: That the Engineer of the City of North Olmsted is <br />hereby irecte to cause said Easement to be recorded in the office <br />of the Recorder of Cuyahoga County. <br />SECTION 3: That this Ordinance shall take effect and be in <br />force rom and after the earliest period allowed by law. <br />PASSED: ~ <br />ATTEST: ~~ <br />~: <br />Nora T.
