<br />AN ORDINANCE AUTT-IORIZING THE BUILDING CMISSIONER
<br />TO PROCEED WI1'Ti THE DEP,'IOLITION OR REMOVAL OF THE
<br />BUILDING CN PERMANF.NT PARCEL N0. 234-22-17 AT
<br />6288 STEARNS ROAD, IN THE CITY OF NORTFI OIMSTED,
<br />AND DECLARING AN EMERGENCY.
<br />ti1HEFtEAS, pursuant to the provisions of Ordinance No. 1331.01 to 1331.99
<br />of the Codified Ordinances of the City of North Olmsted, the Building Commissioner
<br />has determined tha.t the abandoned dwelling lrnown as Permanent Parcel No. 234-22-17
<br />located at 6288 Stearns Road, North Olmsted, Ohio, the record title holder being
<br />Anthony J. Lavati, Jr., is tmsafe, dangerous to hLUnan life, and hazardous to
<br />the safety, health and public welfare of the citizens of the City of North Olmsted,
<br />and
<br />I?TMREAS, notice to repair, remove, and demolish said building was served
<br />by registered letter on said record title holder on February 8, 1979, ordering
<br />said title holder to repair, remove, or demolish said builsing and to commence
<br />such repair, removal, or demolition within sixty (60) days of receipt of said
<br />notice, and
<br />WHEFtEAS, said record title holder, Anthony J. Lavati, Jr., failed to
<br />reverse the Buil,di:ng Comissianer's ordex and has a.lsa failed to fuxther anneal
<br />the decision of the Zoning Board of Appeals to a higher tribunal of competent
<br />jurisdiction and at this time has failed to comply with the order of the Building
<br />Corrnnissioner.
<br />NOW, TfiEREFORE, BE IT ORDAINED BY TfIE COUNCIL OF THE CITY OF NORTH 0I14STED,
<br />COUN1'Y OF CUYAHOGA, AND STATE OF OHIO:
<br />SECTION 1: That Council deems it necessary to proceed with the demolition
<br />and remova the detached garage at 6288 Stearns Road, North Olmsted, Ohio,
<br />also lmown as Permanent Parcel No. 234-22-17, owned by Anthony J. Lavati, Jr.,
<br />whose mailing address is 4539 Martin Drive, North Olmsted, Ohio, 44070, by reason
<br />of the fact that said dwelling has been determined to be dangerous to hwnan life
<br />and a hazard to the public safety, health and welfare of the citizens of the City
<br />of North Olmsted, Ohio, and that the cost of said demolition in removal be paid
<br />from the General FLmd of the City of North Olmsted and charged to the owner as
<br />a special assessment or lien on such parcel of land and assessed and collected
<br />in the manner of other assessments as provided by law.
<br />SECTION 2: That the Clerk of Cotmcil be and she is hereby directed to forward
<br />a copy of t?Fiis Ordinance to Anthony J. Lavati, Jr., 4539 Martin Drive, North Qlmsted,
<br />Ohio 44070.
<br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure
<br />imediately necessary for the preservation of the public health, safety and welfare,
<br />and for the further reason tha.t the dila-Didated condition of said fence is a serious
<br />hazard to the health, safety, and welfare of the citizens of North Olmsted, and
<br />further provided it receives the affirmative vote of two-thirds of all members of
<br />CoLmcil, it shall take effect and be in force immediately upon its passage and
<br />approval by the Mayor.
