*M004% o <br />...,? <br />. <br />?- J A <br />++.a <br />CI'TY OF NORTH OLT'?STED <br />ORDINANCE N0. 79 - 107 <br />BY: L-2aj214?? <br />AN ORLIINANCE ANIENDING SECTION 331.11 EN'z'ITLED <br />"TURNING INTO PRIVATE DRTVEUiAY, ALLEY OR. <br />BUILDING" OF CHAPTER 331 OF '?'HE TRAFFIC CODE <br />ENTITLED "OPF.RATION GENERALLY" <br />WfEREAS, upon careful consideration this Colm.cil has determined <br />that the existing Section 331.11 of the Codified Ordinances is deficient <br />in tha.t it fails to require the motoring public to yield the right-of-way <br />to persons who are operating bicycles on the sidewalks within the City, and <br />WHEREAS, it is the desire of tris Council to clarify the language <br />which would be broad enough to include all individua.ls, either pedestrians <br />or individuals riding bicycles, who are on the sidewallcs and lawfully using <br />the same. <br />NOj'.', '!'REREFORE, BF. IT ORDAINED BY THL CIT'Y OF NORTH OBISTED, COLJPUY <br />OF CUYAHOGA, AND STATE OF OHIO: <br />Section l: That Section 331.11 of the Codified Ordinances of th.e <br />City of North Olmsted entitled "Turning Into Private Driveway-, Al1ey or <br />Building" of Chapter 331 entitled "Oneration Generally" which now reads: <br />"331.11 T'iJRNING INTQ PRIVATE DRIVEWAY, ALLEY OR Bt?ILDING. <br />The driver of a vehicle intending to turn into a private road or <br />dr.iveway, alley or building from a public street or hignway shall be <br />governed by the following rules: <br />(a) Apbroach for a right turn and a right turn sr.all be made as <br />close as nracticable to the right-hand curb or edge of the <br />roadway. <br />(b) ilpon a roadway where traffic is proceeding in opposite <br />direction s, apnroach for a left turn and a left turn shall <br />be made from that portion of the right half of the roadway <br />nearest the center line thereof. <br />(c) Upon a roadway where traffic is restricted to one direction, <br />annroach for a left turn and a left turn shall be made as <br />close as practicable to the left-hand curb or edge of the <br />roadway. <br />It sha11 be the duty of the driver of any vehicle entering a <br />nrivate road or driveway, alley or building to yield the right-of-way to <br />pedestrians lawfully using the sidewalk or sidewalk area extending across <br />any alleyway." <br />be and the same is hereby amended and as amended shall read as follows: <br />331.11 TURNING INTO PRIVATE DRIVEWAY, ALLFY OR I3UILDING. <br />The driver of a vehicle intending to turn into a nrivate road or <br />driveway, alley or building from a public street or highwaysha.ll be <br />goveined by the following rules: <br />(a) Approach for a right turn and a right turn shall be made as <br />close as practicable to the right-hand curb or edge of the <br />roadway.
