R. 58 <br />DATE OF ENACTMENT'February 20, 1979 <br />An emergency ordinance enacted hy the City of North Olmated, Cuyahoga County, Ohiot <br />in the matter of the hereinafter described improvement, under the supervision of the <br />Director of Transportation. _ , •-- , ; . '' <br />. .r <br />WHEREAS, the public interest and safety demands the improvement of that part of' <br />Dover Center Rd, C.R. 58 situated in the City of North Olmsted, in the county of _ <br />Cuyahoga, State of Ohio, and described as follows: ' . <br />Rehabilitation of the pavement to improve the riding quality and safety'of the <br />road and to increase the structural integrity of the pavemento The p.roject <br />includes: improving subsurface and surface drainage; constructing a continuous <br />left turn lane from Lorain Rd. to Brookpark Rdo Ext. and other intersections <br />within the existing right of way; widening to a 28 ft. pavement; removing <br />existing asphalt; repairing the concrete base; resurfacing with 2 in, of 402 <br />Binder course and 1 ine of 404 rubberized asphalt; installing semi actuated <br />traffic signals with interconnectionof Butternut Ridge Rd, Lorain Rd. & <br />Brookpark Rd, Ext.; constructing sidewalks; and installing thermoplastic <br />stripinge <br />NOW THEREFORE, Be it ordained by the Council of the City of North Olmsted, Ohio: <br />SECTION I (Consent) <br />That it is declared to be in the public interest that the consent of said City <br />be and such consent is hereby given to the Director of Transportation to construct the <br />above described improvement, in accordance with plans, specifications and estimates as <br />approved by the Director. <br />SECTION II (Cooperation) <br />That said City hereby proposes to cooperate with the State of Ohio, in the cost of <br />the above described improvement as follows; <br />Assume and contribute the -entire cost and expense of the improvement less the <br />amount of•County Motor Vehicle $5.00 License Tax Funds administered by Cuya- <br />hoga County and Federal-aid Urban "M": funds set aside by the Director of <br />Transportation and the Northeast Ohio Areawide Coordinating Agency (NOACA) <br />for the financing of this improvement-and the preliminary engineering from <br />funds allocated by the Federal Highway Admin., U.S. Dept. of Transportation. <br />SECTION III (Authority to Sign) <br />That the Mayor of said City, is hereby empowered and directed on <br />behalf of the City to enter into agreements with the Director of Transportation necessary <br />to complete the planning and construction of this improvement. <br />SECTION IV <br />That upon completion of said improvement, said City, will thereafter keep said <br />high4ay open to traffic at all times, and <br />(a) Maintain the improvement in accordance with the provisions of the statutes <br />relating thereto and make ample financial and other provisions for such <br />maintenance; and <br />(b) Maintain the right-of-way and keep it free of obstructions in a manner satis- <br />factory to the State of Ohio and hold said right-of-way inviolate for public <br />highc:ay purposes and permit no'signs, posters, billboards, roadside stands <br />or other private installations vithin the right-of-way limits; and - <br />. ; . <br />Road ORDINANCE N0.?.79-34 <br />(c) place and r-aintain all traffic control devices conforming to the Ohio Manual <br />of Uniform Traffic Control Devices on the improvement in compliance uich the <br />provisions of Section 4511.11 and related sections of the Ohio Revised Code.
