CITY OF NORTH OLMSTED <br />ORDINANCE NO. 76- ~~~ <br />BY : i~~ ~d/~. ~ ~_... <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH <br />KOSTER & ASSOCIATES, ARCHITECTS, INC., FOR THE <br />PURPOSE OF PROVIDING ARCHITECTURAL SERVICES WITH <br />RESPECT TO THE ADDITION OF SECOND FLOOR COMMUNITY <br />ROOMS AND OUTSIDE TENNIS COURTS AT THE RECREATION <br />COMPLEX AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has applied for a <br />federal grant under the Local Public Works Capital Develop- <br />ment and Investment Program, and <br />WHEREAS, the regulations of said act require that the City <br />of North Olmsted have a contingent agreement with an architect <br />as it relates to the project submitted in its application, and <br />WHEREAS, it is the desire of this Council. to have the <br />Mayor enter into a contingent contract with Koster & Associates, <br />Architects, Inc., for the purpose of utilizing their services <br />in the event that the City of North Olmsted's application <br />for an addition to the Recreation Complex and outside tennis <br />courts is approved. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Mayor of the City of North Olmsted is <br />hereby authorized to enter into an agreement, a copy of which is <br />attached hereto, made a part hereof and marked Exhibit A, for <br />architectural services with Koster & Associates, Architects, Inc. <br />for the addition of second floor community rooms and outside <br />tennis courts. Said agreement, however, shall be binding on <br />the City of North Olmsted only in the event that the City obtains <br />a grant under the aforesaid Public Works Program. <br />SECTION 2: That this ordinance is hereby declared to be <br />an emergency measure immediately necessary for the preservation <br />of the public health, safety and welfare, and for the further <br />reason that it is immediately necessary to submit said agreement <br />so that the City's application may be~conside.red, and further <br />provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />PASSED : ~tu.,~ ~uc/ 7 /'7~ <br />ATTEST: <br />~ ~~ <br />G~~ ,, . <br />Nora T.
