CITY OF NORTH OLb4STED <br />ORDINANCE N0. 76 -~~~ <br />AN ORDINANCE AUTHORIZING THE MAYOR OF <br />THE CITY OF NORTH OLMSTED TO PURCHASE <br />REAL PROPERTY FROM MR ~ MRS. RAYMOND <br />LEE TO BE USED AS A WALKWAY AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, this council has determined that with the construction <br />of Interstate 480 that students attending North Olmsted High School <br />living South of the proposed I-480 highway and West of Fitch Road will <br />be unable to have ready access to the North Olmsted High School, and <br />WHEREAS, with the purchase of approximately 10 feet of land <br />from Mr. ~ Mrs. Raymond Lee on Revere Drive, a plan may be formulated <br />so as to provide students attending North Olmsted High School ready <br />access to the school. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Mayor be and he is hereby authorized <br />to enter into an agreement with Raymond and Kathleen Lee for the <br />purchase of the Easterly ten (10) feet of Permanent Parcel No. <br />235-17-51 for an amount not to exceed Four Hundred Dollars ($400.00), <br />all in accordance with the purchase agreement and legal description <br />which is attached hereto and made a part hereof and marked Exhibit "A" <br />SECTION 2: That the Director of Finance be and he is hereby <br />authorize t~ o pay to the said Raymond and Kathleen Lee the sum of <br />$400.00, which amount shall be paid contemporaneously with the receipt <br />of the properly executed Warranty Deed as well as evidence of title. <br />SECTION 3: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare and for the further reason that one <br />of the terms of the purchase of said land is that it be consummated <br />within 60 days, and further provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor <br />DATE PASSED : ~' ~ ~ ~~/_~ <br />ATTEST: <br />~ i ~/, <br />NO HILL, CLERK CO NCIL <br />APPROVED: 9 ai ~~, <br />-, <br />RA MAN, <br />~. <br />....~:: <br />UNCIL <br />
