CITY OF NORTH OLMSTED <br />e. <br />ORDINANCE N0. 76 -~~ <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER <br />INTO AN AGREEMENT WITH SPARKY DiBENEDETTO <br />FOR THE MAINTENANCE OF STREET LIGHTS ON <br />BROOKPARK EXTENSION AND SPARKY LANE WITHIN <br />THE CITY OF NORTH OLMSTED <br />WHEREAS, this Council has determined that it is both <br />desirable and necessary to install street lights on Sparky <br />Lane as well as the Brookpark Extension, and <br />WHEREAS, this Councilras further determined that the <br />City is not presently able to finance thenaintenance of said <br />street lights due to the City's present adverse financial <br />condition, and <br />WHEREAS, Sparky DiBenedetto has agreed that he will <br />pay for the operation of said street lights for eighteen <br />months after which time the City will assume any and all <br />future costs of maintenance and operation of_ said street <br />lights. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized <br />to enter into an agreement with Sparky DiBenedetto concerning <br />the cost of maintenance of street lights on Sparky Lane and <br />Brookpark Extension, copy of which agreement is attached <br />hereto and made a part hereof and marked Exhibit A. <br />SECTION 2: That the Director of Finance is hereby <br />directe~ccept payments and to issue statements if <br />necessary to effect the collection of the agreed upon amount <br />as specified in Exhibit A. <br />SECTION 3: That this ordinance shall take effect and <br />be in force rom and after the earliest period allowed by law. <br />PASSED: ~ <br />ATTEST: <br />°~ .~ <br />N , E K F U <br />APPROVED : 8/f ~-~( <br />e9~""''~ <br />n.., _ ,.:.µav,... <br />..... „yax~. <br />--~" <br />IL <br /> <br />
