G~ <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR THE <br />CONSTRUCTION OF A SANITARY SEWER OVER <br />PERMANENT PARCEL N0. 232-3-16 LOCATED ON <br />MARTIN DRIVE IN THE CITY OF NORTH OLMSTED <br />WHEREAS, the Engineering Department has determined that <br />it is necessary to construct a redesigned sanitary sewer to <br />service several lots on Martin Drive owned by Ouality Concrete <br />Company, and <br />WHEREAS, it is the desire of the City of North Olmsted <br />and Quality Concrete Company, the owner of Permanent Parcel No. <br />232-3-16, to have the City's rights in said sanitary sewer <br />clearly specified and made a matter of record by recording a <br />formal easement, and <br />WHEREAS, this Council deems it in the best interest to <br />accept said easement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECfiION l: That this Council does hereby accept an easement <br />from Quality oncrete Company for the maintenance, construction <br />and operation of a sanitary sewer pipe over and on the property <br />described herein and more fully described in the copy of the <br />easement attached hereto, marked Exhibit A and made a part hereof <br />as though fully rewritten herein. <br />SECTION 2: That the Finance Department is directed to pay <br />to Quality concrete Company One Dollar ($1.00) which is the <br />consideration for the granting of the easement described herein. <br />SECTION 3: That the Engineering Department of the City <br />of NortFi~~msted-is hereby directed to cause the easement to be <br />recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this ordinance shall take effect and be <br />in force~rom and after the earliest period allowed by law. <br />PASSED: ,~~~ <br />ATTEST: <br />N H L K OF UNCIL <br />APPR ED : G ~~~1t <br />Y <br />D IL <br />~~~ s •~,/fj~ <br /> <br />
