CITY OF NORTH OLM5TED <br />ORDINANCE NO. 76 - ,1/O <br />AN ORDINANCE LIMITING THE DUTIES OF <br />THE DIRECTOR OF LAW OF THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, .the Charter of the City of North Olmsted at <br />Article V Section 2 requires the Director of Law to "...perform <br />all other duties now or hereinafter imposed upon city solicitors by <br />the Laws of the State of Ohio unless otherwise provided by ordinance <br />of the Council...", and <br />WHEREAS, a recent Supreme Court case has interpreted the <br />General Law of the State of Ohio so as to require the City Solicitor <br />under the statutory form of government to not only represent the <br />City in all matters, but also the Board of Education, and <br />WHEREAS, it is the desire of this Council by virtue of the <br />aforesaid Charter provision to limit the duties of the Director of <br />Law of the City of North Olmsted to that of only representing the <br />City of North Olmsted and not the Board of Education; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECT-ION l: That the Director of Law of the City of North <br />Olmsted shall act as legal counsel and serve in such capacity the <br />Mayor, Council, Administrative officers, departments, and the <br />Commissions and Boards of the City of North Olmsted. He shall not <br />be required to represent the Board of Education as is now required <br />of City Solicitors under the general laws of the State of Ohio. <br />SECTION 2: That this ordinance is hereby declared to be <br />an emergency measure immediately necessary for the preservation of <br />the public health safety and welfare, and for the further reason <br />that it is necessary to immediately determine the duties of the <br />Director of Law, and further provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: ~ y, /',~;~- <br />ATTEST: /~ <br />/. ~~ <br />NORA T.
