CITY OF NORTH OLMSTED <br />ORDINANCE NO. 76 - ,~~ <br />BY: <br />AN ORDINANCE AUTHORIZIId~ SPECIAL COUNSEL FOR THE <br />CITY OF NORTH OLMSTED TO ENTER INTO A CONSENT <br />DECREE FOR AND ON BEHALF OF THE CITY OF NORTH <br />OLMSTED AND THE VARIOUS PUBLIC OFFICIALS NAMED <br />AS DEFENDANTS IN THE CASE OF NEEDLES VS. CHRISTMAN <br />ET AL, CASE NO. C73-1058 IN THE UNITED STATES <br />DISTRICT COURT FOR THE NORTHERN DISTRICT OF OHIO, <br />EASTERN DIVISION AND DECLARING AN EMERGENCY <br />WHEREAS, the City of North Olmsted and various public officials <br />of the City of North Olmsted were named as Defendants in the lawsuit <br />entitled. Needles vs. Christman et al, Case No. C73-1058 in the <br />United States District Court for the Northern District of Ohio, <br />Eastern Division, and <br />WHEREAS, the City had previously retained the services of <br />attorneys Eli Manos and Michael Gavin to represent the City as <br />well as various other public officials in the aforementioned case, and <br />WHEREAS, said attorneys have negotiated with the Plaintiff in <br />an effort to reach a settlement acceptable both to the City and <br />the various public officials, and <br />WHEREAS, the aforesaid attorneys have concluded negotiations <br />and reached a proposed settlement, which is attached. hereto and <br />made a part hereof, marked Exhibit A and entitled. Consent Decree, and <br />WHEREAS, it is the desire of this Council and the administration <br />to authorize Attorneys Eli Manos and Michael Gavin to enter into the <br />Consent Decree, marked Exhibit A, for and. on behalf of the City of <br />Nt~rth Olmsted and the various public officials named as Defendants <br />in said lawsuit. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That special counsel for the City of North Olmsted <br />and the various public officials named, as Defendants in the case <br />of Needles vs. Christman et al, Case No. C73-1058 in the United, <br />States District Court for the Northern District of Ohio, Eastern <br />Division are hereby authorized and directed to enter into a <br />Consent Decree, which is attached hereto and made a part hereof, <br />and marked Exhibit A, entitled. Consent Decree. <br />SECTION 2: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety, and welfare, and for the further reason <br />that it is necessary to protec the interest of the City of North <br />Olmsted and, the various public officials, and. further provided it <br />receives the affirmative vote of two-thirds of all members elected. <br />~.. <br />
