CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~~ <br />BY • i.f. <br />AN ORDINANCE ACCEPTING AN EASEMENT TO BE <br />USED FOR THE INSTALLATION OF UTILITIES TO <br />SERVICE THE RECREATION C~ER ON LAND <br />SITUATED ON CANTERBURY ROAD IN THE CITY OF <br />NORTH OLMSTED, AND DHCLARING AN EMERGENCY. <br />WHEREAS, George P. Bohnert and Gladys Bohnert are the owners <br />of a parcel of land situated on the east side of Canterbury Road, <br />namely Permanent Parcel No. 232-33-38, and <br />WHEREAS, the administration deems it in the best interest of <br />the City to service the Recreation Center with utilities originating <br />within the Canterbury Road right-of-way, and <br />WHEREAS, it is the desire of the City of North Olmsted and <br />George P. Bohnert and Gladys Bohnert to have the City's rights <br />established in the parcel by virtue of a perpetual easement at <br />a cost of $1,000.00, and <br />WHEREAS, this Council deems it in the best interest of the <br />City to accept the easement described herein; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND ST1,TE OF OHIO: <br />SECTION l: That this Council does hereby accept an easement <br />from George P. Bohnert and Gladys Bohnert for the purpose of <br />installing utilities to service the Recreation Center over and <br />through the land situated on the east side of Canterbury Road in <br />the City of North Olmsted and more fully described in the copy of <br />the easement attached hereto, marked Exhibit "A", and made a part <br />hereof as though fully rewritten herein. <br />SECTION 2: That the Finance Director is directed to pay to <br />George P. Bohnert and Gladys Bohnert $1,000.00 which is the con- <br />sideration for the granting of the easement described herein. <br />SECTION 3: That the Engineering Department of the City of <br />North Olmsted is hereby directed to cause the easement to be recorded <br />in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that it <br />is immediately necessary to provide the residents of the City of <br />North Olmsted with recreation facilities, and further provided it <br />receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED • A.~,~~, y„ u-~c-/ /~ /~T <br />ATTEST: <br />NORA T.
