~, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~Q <br />BY• ~ <br />AN ORDINANCE ACCEPTING A 15 FT. EASEMENT <br />TO BE USED FOR POSSIBLE FUTURE ROADWAY <br />IMPROVSMSNT ON LAND SITUATED ON ~iORTH <br />PARK DRIVE IN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AW EMERGENCY. <br />WHEREAS, Donald and Shirley Wiley are the owners of a parcel <br />on the southerly side of North Park Drive, namely Permanent Parcel <br />No. 232-7-20, and <br />WHEREAS, the City of North Olmsted has obtained easements from <br />other property owners on North Park Drive for possible road right-of- <br />way widening, and <br />WHEREAS, it is the desire of the City of North Olmsted and <br />Donald and Shirley Wiley to have the City's rights established in the <br />parcel hereinbefore mentioned, and <br />WHEREAS, this Council deems it in the best interest of the City <br />to accept the easement described herein; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept an easement <br />from Donald and Shirley Wiley for the purpose of possible future <br />roadway improvement on land situated on North Park Drive. in the City <br />of North Olmsted and more fully described in the copy of the ease- <br />ment attached hereto, marked Exhibit "A", and made a part hereof as <br />though fully rewritten herein. <br />SECTION 2: That the Finance Department is directed to pay <br />to Donald and Shirley Wiley One Dollar ($1.00) which is the considera- <br />tion for the granting of the easement described herein. <br />SECTION 3: That the Engineering Department of the City of <br />North Olmsted is hereby directed to cause the easement to be recorded <br />in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is immediately necessary to provide for the orderly development <br />of the City's streets and rights-of-way, and further provided it <br />receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED • -~~~y-~~~ <br />ATTEST: <br />NORA T.
