CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 -~ <br />BY: Mr. Giesser <br />AN ORDINANCE AMENDING SECTION 947.02 <br />ENTITLED "SELLING MERCHANDISE" OF <br />CHAPTER 947 ENTITLED "PARKS" OF THE <br />CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED. <br />WHEREAS, this Council recognizes that Section 947.02 of the <br />Codified Ordinances has heretofore prohibited the selling of merchan- <br />dise within the City Park unless a concession to do so was first granted <br />by Council, and <br />WHEREAS, it is the desire of Council to permit non-profit <br />groups and organizations to rent the facilities in North Olmsted Park <br />without the requirement of first obtaining a concession to sell merchan- <br />dise from City Council, and <br />WHEREAS, it is also the desire to Council to prohibit the use <br />of Park facilities for the sale of merchandise by private individuals, <br />partnerships, or corporations who operate solely for profit, exclusive <br />and apart from a non-profit group or organization; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 947.02 entitled "Selling Merchan- <br />dise" of Chapter entitled "Parks" of the Codified Ordinances of <br />the City of North Olmsted be and is hereby amended, and as amended <br />shall read as follows: <br />"947.02 Selling Merchandise <br />No person, partnership or corporation operating for profit exclusive <br />and apart from a non-profit group or organization shall sell or offer <br />for sale any goods, wares, merchandise, or services in the City parks." <br />SECTION 2: That Section 947.02 as previously adopted, and <br />any other ordinance or sections of ordinances in conflict herewith are <br />hereby repealed. <br />SECTION 3: That this ordinance shall take effect and be <br />in force from and after the earliest period allowed by law. <br />PASSED : ~ girl. ~f[, , <br />ATTEST Y/ <br />°~_ <br />Nora T.
