<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 75 - ~~9 <br />BY: Mr . Beaty <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER <br />INTO AN AGREEMENT FOR THE USE OF THE POOL <br />OWNED BY JOHN LEE AND KATHERINE D. ROBERTS, <br />24773 THERESA LANE, NORTH OLMSTED, OHIO, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted is anxious to provide <br />recreational opportunities for the citizens of North Olmsted; and, <br />WHEREAS, John Lee and Katherine D. Roberts, 24773 Theresa <br />Lane, North Olmsted, Ohio, have offered the use of a pool located <br />at the abovementioned address in accordance with the terms and <br />conditions set forth in an Agreement, marked Exhibit "A", and <br />attached hereto; and, <br />WHEREAS, the City of North Olmsted is financially unable to <br />provide a pool for the use of its citizens and their children enrolled <br />in the North Olmsted recreational program; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to enter into <br />an Agreement, attached hereto and marked Exhibit "A", with John Lee <br />and Katherine D. Roberts for the use of their pool located at 24773 <br />Theresa Lane, North Olmsted, Ohio, <br />SECTION 2: That this ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />public peace, health, safety, and welfare, and for the further <br />reason that it is immediately necessary to include this facility in <br />the recreational program of the City of North Olmsted in the month <br />of May, which is the time in which the swimming season begins, and <br />further provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />PASSED a~/O ~ <br />ATTEST: <br />r <br />NORA T, HILL, CLERK OF COUNCIL <br />FRANCIS J.
