MINUTES OF A MEETING OF THE COIINCIL <br />OF THE CITY OF NORTH OLMSTED, OHIO <br />APRIL 21, 1959 - - 8:28 P.M. <br />Present were Paul J. Gareau, Mayor; Ralph A. Hazelton, President of Council; <br />Evelyn Hinkel, Eddie Hixson, Wm. H. Kramer, Mary Alice Lynch and James T. Wilson. <br />Also present were Lloyd E. Barnes, Service Director and Acting Safety Director; <br />C. J. Oviatt, Solicitor; Alex Kanareff, Engineer; and E. M. Christman, Clerk. <br />Absent:. Francis O'Neill, Bruce MacDonald and Alice Dobbins, Treasurer. <br />The minutes of the regular meeting of April 7th were approved as read. <br />The Mayor advised that there will be a meeting at North Olmsted High School on <br />April 28th at 8s00 P.M. relative to narcotics and suggested that members of the <br />Fire and Police Departments endeavor to attend and also stated that the meeting <br />would be of interest to all members of the administration. <br />The Safety Director requested the Finance Committee to advise as to whether or <br />not any determination had been arrived at in connection with the purchase of <br />a police car and Mr. Wilson advised that Committee has note as yet, had a <br />meeting. <br />The Safety Director reported that he had discussed the "Breathalizer" with the <br />Prosecutor and that the findings of the equipment will be admitted as evidence. <br />He stated that the purchase would actually result in a savings; inasmuch as <br />each individual test now conducted at Berea entails a cost of $10.00, roughly <br />X1,000 per year, and the actual cost of the machine, complete with 48 test kits, <br />training and shipping, is ffi655.00. <br />In reply to Mr. Kramer, the Solicitor advised that the "Breathalizer" is legally <br />acceptable in establishing a state of intoxication. <br />The President of Council advised that since the purchase of the "Breathalizer" <br />would be over X500 but under X1,000, the purchase would be under the juris- <br />diction of the Board of Control and would not requixe action of Council. The <br />Safety Director stated that he was aware of this fact but that he would like <br />to have the approval of Council for the use of the equipment. Mr. Wilson stated <br />that he felt the purchase should be referred to the Finance Committee for con- <br />sideration, due to the fact that the purchase of a police car is also being <br />considered at this time. <br />It was moved by Mr. Wilson, seconded by Mr. Kramer, that the purchase of the <br />"Breathalizer" be referred to the Finance Committee to be reported on at the <br />next Council Meeting. "Yeas" Hinkel, Kramer, Lynch. "Nays" Hixson. <br />Wilson <br />The Engineer returned to Council the petition submitted by residents of Twin <br />Circle Drive relative to curbs and gutters. He reported that a total of 1,754 <br />feet of frontage exists; 60~ of the frontage is required to carry the petition, <br />or 1,052 feet, and owners of only 972.72 feet signed the petition. Mr. Wilson <br />advised that a very unusual situation is involved in this area. Twin Circle <br />Drive actually forms a "T" and some of the residents would like to know if the <br />portion which runs north and south could be petitioned separately. The Engineer <br />stated that a 60~ front footage would still be required and the legal description <br />on the petition would have to define exactly the area covered. Mr. Wilson <br />requested the Engineer to check the feasibility of such a plan and the Solicitor <br />advised that a new petition would then be required. <br />Mr. Kuhn of Floyd Browne advised that final drawings of the proposed sanitary <br />sewer system were turned over to the City of North Olmsted, including five <br />complete sets of the documents. The remaining work, which is minor, would <br />consist of the bidding document, scope of work to be bid and related items. <br />This particular phase will not be completed until such time as a determination <br />is arrived at as to how much of the sewer plan will be developed. Two complete <br />copies of the drawings and specifications should be forwarded to the Dept. of <br />Health, State of Ohio, for their approval. <br />The Service Director requested Mr. Kuhn to advise as to whether any changes in <br />the plans would result in an additional cost. Mr. Kuhn stated that there was <br />a mutual agreement to the effect that their concern would meet with the city <br />administration until all locations were acceptable; but after the plans are <br />officially accepted by Council, there will be a charge for changes to the <br />- 1 - <br />
