MINUTES OF THE SPECIAL MEETING OF THE COUNCtL

<br />DECEMBER 30, 1963 - 8:00 P.M.
<br />Present were Dewey N. limpert, President Pro Tem of Council; Henry Caster, Ra1ph
<br />Ch'ristman, James Leonard, Francis J. 0'Neill, Norman Van Zandt, A. L. Mangani,
<br />Also present were George Schaaf, Law Director; Louise Ha71, Clerk.
<br />Absent: Bruce MacDonald, President of Council.
<br />Cduncilman Christman expiained that this Special Meeting of Gouncil had been
<br />caited for the purpose of considering the finding of the Board of zoning Appeals
<br />in connection with the application filed by Dimensions III, Inc. (Seuffert
<br />Construction Company, 29333 Lorain Road, North Olmsted, Ohio) for an
<br />interpretation provided for in Section 1133.11 of the Zoning Code of the words
<br />"hotel", "motel" or "apartment motel" as contained in Section 1171.Oz, Paragraph
<br />(b) Subsection 7. This application, together with plans for a proposed buflding
<br />whicM the applicant desginated as a"motor hotel", was filed with the app)icant's
<br />request that the toning Board of Appeals find that this use was encompapsed in the
<br />language of the foregoing section. On December 3, 1963, the Board of Zoning
<br />Appedls made a finding in favor of the applicant to the effect that the plans of the
<br />propased bu+ld'+ng or buildings were covered by said section as an "apartment motel"
<br />and instructed the Building Commissioner to issue the permit.
<br />It was also explained to the Council that under Section 1133.14 of the 2oning
<br />Code the decision of the Board of Zoningi Appeals would become final unless wtthin
<br />thirty days of that decision Council, by motion concurred in by a majority of
<br />its menbers eligible to vote, took such action as is provided for in Seckion
<br />1133.16.
<br />DiScussion ensued and it was pointed out that the issuance of this permit would
<br />result in a multi-family dwelling or apeirtment which would be in violatiean pf
<br />many requirements of the Zoning Code suc;h as density, area requirement per
<br />suite, parking, etc. It was also painte;d out further that the designatiQn as
<br />"motor hotel" did not, in any way, chancae the fundamentai character of the
<br />proposed building. lt was the feeling of the Council that the pians showed
<br />nothing but a multi-family dweiling or apartment building and that the grantiMg
<br />of the permit would simply be an approval of a viotation of the Zoning Code
<br />requirements for apartments.
<br />The opinion also was expressed that the use of the title on the plans shC?uld not
<br />be the test of the type of buitding prolDosed to be erected when such plans
<br />themselves should `be the determining factor of the type of use requested.
<br />It was moved by Mr. Christman, seconded by Mr. Caster, that the ruling, determinotiQn
<br />or order of the Board of Zoning Appeals made on December 3, 1963, on the applic8tipn
<br />of Dimensions tll, lnc.(Seuffert Construction Company, 29333 Lorain Road, North
<br />0lmsted, Ohio) be and the same is hereby reversed and that the Clerk notify the
<br />8oard of Zoning Appeals and the Building Commissioner of such reversal. "Yeas"
