MINUTES OF THE SPECIAL MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTID <br />OCTOBER 29, 1990 <br />Present: Council President Boel~r, Council Members Babas, <br />Leonard, McKay, Nashar, O'Grady, Saringer, Tallon. <br />Also Present: Assistant Clerk Barbara Seman. <br />President Boehmer called the meeting to order at 7:18 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Mrs. Saringer, Chairperson of the Building,. Zoning and Development <br />Committee reported: 1) The twn items on the agenda tonight are the <br />approval of special permits for Suburban Auto Body and Nutron Nameplate, <br />Inc. Council must act on these before the 30-day time limit. Both <br />permits were approved by the BZA. <br />Mr. O'Grady asked whether Council hadn't asked for fencing in the case <br />of Suburban Auto Body when it had previously been considered. <br />Mr. Tallon replied that fencing was in place and would not be moved. <br />The problem is Suburban is going to put a building on the area <br />previously used for storage of smashed arxi damaged vehicles. This means <br />that those vehicles will be left in visible areas on the outside of the <br />building. Because BZA approved, he will concur with the special permit; <br />however, he would. like to express disapproval at the way the matter was <br />handled. <br />Mrs. Babas questioned why Council Members should vote for approval if <br />they felt the issue was wrong. <br />Mr. Tallon and Mr. O'Grady replied that Council cannot override BZA. <br />Mr. Tallon explained. that BZA acts as a quasi-court. If Council ruled <br />against them, they would be acting in an administrative capacity and <br />would, therefore, lose legislative ;irnn„r,;ty, <br />Mr. McKay suggested that perhaps Council could advise BZA of their <br />concerns so future problems could be avoided. <br />Mrs. Saringer moved to approve the special permit to add to non- <br />conforming building for Suburban Auto Body; second by Mr. O'Grady; <br />unanimously approved. <br />Mrs. Saringer moved to approve that a special permit be granted to <br />Nutron Nameplate, Inc. to acid to non-conforming building; second by Mr. <br />O'Grady; passed unanimously. <br />LEGISLATION <br />Mr. Leonar moved to <br />". O'Grady. Roll call: <br />failed. <br />reconsider Ordinance No. 90-127; second by Mr. <br />Affirmative votes - 2; Negative votes - 4. Motion <br />1 <br /> <br />
