MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTID <br />SEPTEI~ER 1, 1992 <br />Present: Council President BoeYmier, Council M~nbers Bahas, Leonard, Lind, <br />McKay, Musial, Nashar, Saringer <br />Also Present: Mayor Ed Boyle, Law Director Michael Gareau, Finance Director <br />James Burns, Clerk of Council Barbara Seman <br />Council President Boehmer called the meeting to order at 8:05 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the meeting of August 18, 1992 were approved as written. <br />President Boehmer armounced the following: Ordinance No. 92-126 would be added to <br />the agenda; Ordinance Nos. 92-109, 92-110, 92-123, 92-124, and 92-12b would be <br />passed under suspension of the rules. <br />Mayor Boyle reported: 1) On September 8, two new policemen, Mark Goodwin and Simon <br />Cesareo, will be sworn in to bring the Department up to strength. <br />2) The Building Department has available the guidelines for the enterprise zone and <br />the comnninity reinvestment area. <br />3) The Service Department, under the direction of City Forester Dave Wendell, has <br />redesigned the landscaping around the Veterans' Memorial at the Park. <br />4) Homecoming was a success this past weekend, and our community showed that it had <br />a big heart. Because of the destruction of hurricane Andrew, the city collected <br />goods and money for the victims in Florida and Louisiana. We were fortunate to <br />have Senator John Glenn attend our Ho~necoaning on Saturday afternoon to kick off our <br />collection campaign. During the weekend, we collected approximately $200 in cash <br />and several thousand dollars in goods, which was then donated to the Salvation <br />Army. <br />Law Director Gareau reported: 1) A hearing was held in the Court of Appeals with <br />regard. to the Lester case. A briefing schedule was set, however, the plaintiff <br />failed to file a brief according to the schedule. We plan to call this to the <br />attention of the Court of Appeals; and, presumably, the case should be dismissed as <br />a result of this omission. <br />2) A deposition was taken yesterday in a personal injury case dealing with a young <br />man who ran into a delineator stake on a tree lawn on Chase Drive. A motion for <br />summary judgment will soon be filed. <br />3) A pre-trial hearing was held on the case of Packer vs. the City of North <br />Olmsted, which is a false arrest action against Officer Jandeeka and the Police <br />Department. After having completed discovery, a motion for summary judgment was <br />filed last week. Within. the next month or so, briefs will be filed; hopefully, we <br />will be successful in having this case dismissed. <br />5) We are currently preparing a brief to be submitted to the Court of Appeals with <br />regard to the Eliza Jennings case. <br />
