,~, MINUTES OF THE MEETING OF THE COUNCIL <br />} OF THE CITY OF NORTH OLMSTED <br />JUNE 4, 1996 <br />Present: Council President Boehmer, Council Members Limpert, Lind, McKay, <br />Musial, Nashar, O'Grady, Saringer <br />Also Present: Mayor Boyle, Law Director Gareau, Finance Director Burns, Clerk of <br />Council Seman <br />Council President Boehmer called the meeting to order at 8:01 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of Allegiance <br />to the Flag. <br />Mr. McKay moved to approve the minutes of the special Council meeting of May 8, 1996; <br />second by Mr. Lind; motion passed unanimously. <br />Mr. O'Grady moved to approve the minutes of the special Council meeting of May 9, <br />1996; second by Mr. Nashar; motion passed unanimously. <br />Mr. McKay moved to approve the minutes of the Council meeting of May 21, 1996; <br />second by Mr. Musial; motion passed unanimously. <br />REPORTS <br />Law Director Gareau: 1) The NOMBL arbitration has been concluded. Telephone <br />testimony was taken from the president of the union who is currently on leave in Spain. <br />The arbitrator was present for the testimony. <br />2) The motion for summary judgment in the Fattlar case has been filed in the Court of <br />Appeals. The basis of that motion is that it is improper to file a mandamus action in a <br />situation where the position is already occupied. The appropriate action in that situation <br />would be a quo warranto action. <br />3) With regard to the long-standing dispute of the individual who was hurt while working <br />at Homecoming, the city has denied liability. (The individual was putting up lights and fell <br />from a city truck that had been loaned to Community Council.) Community Council's <br />insurance company has sued our insurance company claiming that the city is primarily <br />liable--even though Community Council has approximately a $1,000 deductible and the <br />city has a $30,000 deductible. This has been referred to insurance counsel. <br />4) With regard to the firefighters' collective bargaining agreement, the final step has been <br />reached. A conciliation hearing was held last week. A report and finding should be issued <br />within 30 days. <br /> <br />
