MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MARCH 20, 1996 <br />Present: Council President Pro Tem Musial, Council Members Limpert, Lmd, <br />McKay, Nashar, O'Grady, Saringer <br />Also Present: Mayor Boyle (arrived at 8;30 p.m,}, Law Director Gareau, Finance <br />Director Burns, Clerk of Council Seman <br />Absent: Council President Boehmer <br />Council President Pro Tem Musial called the meeting to order at 8 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of Allegiance <br />to the Flag. <br />Mr. McKay moved to approve the minutes of the Council meeting of March 5, 1996; <br />second by Mr. O'Grady; motion passed unanimously. <br />Mr. Limpert moved to approve the minutes of the special Council meeting of March 9, <br />1996; second by Mr. Nashar; motion passed unanimously. <br />Mr. Musial announced that Mr. Boehmer was absent due to illness. The following <br />committee assignments were made: Ordinance Nos. 96-49 and 96-51 to Finance <br />Committee, Ordinance No. 96-50 to Streets & Drainage Committee. <br />REPORTS <br />Law Director Gareau: 1) He recently issued a legal opinion with regard to the right of the <br />Board of Zoning Appeals to issue use variances. After an analysis of all of the cases and <br />looking at the issue, the legal opinion specifies that in fact they do. The Charter does not <br />limit the Board of Zoning Appeals. This issue was raised because of a proposal to build <br />an indoor soccer facility in an area zoned for industrial use. This use is not permitted in an <br />industrial district. <br />2) Some elements of the firefighters' negotiations have reached the impasse stage and will <br />go to the mediation process beginning tomorrow. If the mediator is unable to resolve the <br />outstanding issues, the next step is fact-finding. The fact-finder's report will go to Council <br />and the firefighters union. Unless Council rejects the fact-finder's report by a three-fifths <br />(3/5) vote, the findings become binding upon the city. <br />3) There are several grievances pending before arbitrators: One involving NOMBL, two <br />from the Service Department and one from the firefighters' union which deals with the <br />_, ~._,..~~ Y . ~ _. _ ,~,~, ._ ~ ,~ .~s,~,..,..:.__ <br />
