MINUTES OF TAE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />_ FEBRUARY 1, 2005 <br />Present: President of Council O'Grady, Council Members Dailey, Gareau, Kasler, <br />Limpert, McKay, Miller, Nashar <br />Also Present: Mayor Musial, Law Director Dubelko, Finance Director Copfer, Clerk of <br />Council Seman <br />President O'Grady called the meeting to order at 8 p.m. in Council Chambers, 5200 Dover <br />Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The minutes of the Council meeting of January 18, 2005 were approved as written. <br />President O'Grady announced the following legislation would be considered for passage under <br />suspension of the rules: second reading, Resolution 2005-9; first reading, Resolution 2005-12. <br />REPORTS <br />Law Director Dubelko: 1) Most of his time over the last two weeks has been devoted to <br />RTA/NOMBL negotiations. He met with RTA negotiators on January 19, and January 31. The <br />negotiating team also met with union officials on January 20. He attended a "Blue Ribbon <br />Panel" meeting with RTA officials and various northeast Ohio leaders on January 31. <br />2) He has submitted Charter review recommendations to the Charter Review Commission for <br />their February 24 meeting. <br />3) January 2S, he attended a Board of Control meeting and other associated City Hall meetings. <br />4) January 28, the ClericallTechnical collective bargaining agreement was executed. It's the last <br />of the collective bargaining agreements for this past cycle. <br />5) January 31, he provided written legal advice to the City Engineer regarding the RFP for real <br />estate appraisals for the new fire station Location. <br />6) February 1, he attended a Board of Control meeting. <br />7) He has appointed a new City Prosecutor, whose appointment was effective January 31. <br />Michael Gordillo is a bright, young lawyer who comes highly recommended from the County <br />Prosecutor's office. He will do a great job for the City of North Olmsted and for the cause of <br />justice in the city. Mr. Gordillo was introduced and welcomed by all. <br />Councilman Limpert asked the Law Director if the city could consider some sort of a lawsuit <br />regarding the RTA/NOMBL negotiations as he does not sense it is truly a "negotiation" with <br />give and take and mutual agreement but rather a "taking" action. Law Director Dubelko said all <br />possibilities are being considered. However, his primary job is at the bargaining table. The RTA <br />negotiators have been instructed to discuss acquisition only. They are not authorized to talk <br />about renewal or about extensions at this time. So, if they're not willing to talk renewal or <br />extension and if the city would choose not to talk about acquisition, we put our 65 employees in <br />jeopardy.
