NORTH OLMSTED CITY COUNCIL <br />MINUTES OF THE PUBLIC HEARING <br />NOVEMBER 28, 2006 <br />Present: President of Council Kennedy, Council Members Barker, Gareau, <br />Dailey Jones, Miller, Orlowski, Ryan, Tallon <br />Also Present: Mayor O'Grady, Law Director Dubelko, Clerk of Council Seman <br />President of Council Kennedy called the public hearing to order at 7:15 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />President Kennedy announced the public hearing was being held with regard to <br />Ordinance No. 2006-164, an ordinance providing .for the amendment of the Zone Map of <br />the City of North Olmsted by rezoning Permanent Parcel Numbers 233-06-001, 233-06- <br />002, 233-06-003, 233-06-004, 233-06-~5, 233-06-006, 233-06-007, 233-06-008, 233- <br />06-009, 233-06-010, 233-06-011, 233-06.012, 233-06-015, 233-06-016, 233-06-017, <br />233-06-018, 233-06-O1.9, 233-06-020, 233-06-021, 233-07-002, 233-07-003, 233-07-009, <br />233-07-025, 233-07-028, 234-OS-004, and 234-06-006, located in the Barton-Bradley <br />Roads area, from their respective current zoning classifications of Limited Industrial, <br />Mixed Use, Single Family Residence and/or Multiple Residence, some of which are split- <br />zoned, to the new Residential Office District classification. <br />Councilman Gareau explained the purpose of this hearing was for interested parties to <br />come forward concerning the legislation and to address Council. He noted Ordinance <br />2006-135 which created the new Residential Office District has passed. We are now <br />talking about the application of that code section to these particular parcels. <br />AUDIENCE FARTIC~PATI~N <br />1) Sam McGee, Portland, Maine, commented his company, ATL Holdings, owns <br />property at 31251 Bradley Road. It's a mixed use facility that has two-thirds of the <br />building as industrial use and one-third as office. They would like to see their building <br />fall outside of this proposed amendment and continue with its existing use because it's <br />the highest and best use of the property. They think that it has in its current composition <br />benefits to both the city's economic base as well as the community of which is it a part. <br />The building was formerly used by Space Age Industrial Design. It's next to Fortney & <br />Weygandt. His company acquired the first mortgage on the property in 2002, and they <br />have expended a considerable sum in terms of carrying costs, and they have repaid <br />almost $300,000 in back property taxes. They invested in it because of its zoning and its <br />attributes. There is a certain buyer out there who is looking for this type of property in its <br />current composition. They are afraid, if it falls under the rezoning, it effectively might <br />amount to a taking of the building. In answer to a question by Councilman Gareau, Mr. <br />McGee said they are close to a deal with a company to purchase the vacant building. He <br />
