CITY OF NORTH OLMSTED ORDINANCE N0. 80- 116 BY: JANET SARINGER AN ORDINANCE ACCEPTING AN EASEMENT FROM FRANK D. LAVALLE AND LOUISE A. LAVALLE FOR THE MAIN- TENANCE OF A TRAFFIC SIGNAL POLE AND FOUNDATION AT THE RECREATION CENTER DRIVE WITHIN THE CITY OF NORTH OLMSTED. WHEREAS, a traffic signal has been placed at the North Olmsted Recreation Center drive, and WHEREAS, the City Engineer has advised this Council that it is in the best interest of the City of North Olmsted to accept an easement with. respect to the maintenance of the traffic signal pole and founda- tion, and WHEREAS, it is the desire of the City of North Olmsted and Frank. D. Lavalle and Louise A. Lavalle to have the City's rights in said pole and foundation easement made a matter of record by recording a formal easement, and WHEREAS, this Council deems it in the best interest of the City of North Olmsted to accept said easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH. OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That this Council does hereby accept an easement. from Fran D Lavalle and Louise A. Lavalle for the construction and maintenance of a traffic signal pole and foundation under and on the property described in said easement which. is attached hereto and marked Exhibit "A" and made a part hereof as though. fully rewritten herein. SECTION Z: That the Engineer of the City of North Olmsted is hereby irecte to cause said easement to be recorded in the Office of the Recorder of Cuyahoga County. SECTION 3: That this ordinance shall take effect and be in force rom and after the earliest period allowed by law.
