I_~ <br />~s <br />.;.,.,,~ <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80-90 <br />BY: MAYOR SWIETYNIOWSKI <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER <br />INTO A LEASE AGREEMENT WITH WEST SHORE CABLE <br />TV (AN OHIO LIMITED PARTNERSHIP) FOR THE <br />TEMPORARY USE OF LAND, NOT TO EXCEED ONE YEAR, <br />AT THE NORTH OLMSTED RECREATION COMPLEX, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the Council and Administration have determined that <br />an area, not to exceed one hundred feet (100') by one hundred feet <br />(100'), be selected for the purpose of installing a Head-End in <br />North Olmsted on a temporary basis. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the following described equipment may be <br />installec~at'a rate .of not less than $225.00 per month and limited to: <br />(a) Attachment of several temporary antennas <br />at the rear of the building. <br />(b) Installing Satellite Receiving Antenna <br />which will be temporarily anchored. <br />(c) Installing small moveable Head-End building <br />in close proximity to the Satellite Antenna. <br />(d) Installing cables from Canterbury Road to <br />these Head-End Facilities. <br />(e) Extend electrical power to these Head-End <br />Facilities. <br />SECTION 2: That all expenses incurred shall be borne by <br />West Shore Ca le TV. Furthermore, all routing and plans must be <br />approved by the City of North Olmsted prior to installation. <br />SECTION 3: That this Ordinance is hereby declared to be <br />an emergency measure immediately necessary for the preservation of <br />the public health, safety and welfare, and for the further reason <br />that it is immediately necessary to implement the construction of <br />Cable TV during favorable construction conditions, and further <br />provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br /> <br /> <br />C UN <br />First reading: ~ s <br />Second reading: <br />Third reading: <br />PASSED: „~ p. /~~ <br />ATTFST~ <br />
