<br />A RESOLUTION DECLARING IT NECESSARY TO IMPROVE, IN CO-OPERATION
<br />WITH THE DIRECTOR OF TRANSPORTATION OF THE STATE OF OHIO,
<br />RELOCATED S. R. 252 FROM THE SOUTH CORPORATION LINE TO THE
<br />I-480 INTERCHANGE BY CONSTRUCTING CONCRETE SIDEWALKS, AND DE-
<br />CLARING AN EMERGENCY.
<br />WHEREAS, this Council, by Ordinance No. 69-123, passed May 20, 1969,
<br />consented to the improvement of Relocated S. R. 252 (Columbia Road) within
<br />the City of North Olmsted by the Director of Transportation of the State of
<br />Ohio; and
<br />WHEREAS, this Council determined that as part of this improvement,
<br />concrete sidewalks should be installed in Relocated S. R. 252, between the
<br />south corporation line and the I-480 interchange, the entire cost of which,
<br />less any Federal, State, or County funds which may be allocated thereto,
<br />will be paid by the City and that the City's share shall be paid in part from
<br />special assessments against the properties specially benefited by the im-
<br />provement;
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North
<br />Olmsted, Cuyahoga County, Ohio:
<br />Section 1. That it is necessary to improve, in cooperation with the
<br />Director of Transportation of the State of Ohio, Relocated S. R. 252 from the
<br />south corporation line to the I-480 interchange by constructing concrete side-
<br />walks on the street.
<br />Section 2. That said street shall be improved as shown on the plans
<br />hereinafter referred to and now on file in the office of the Clerk of this
<br />Council.
<br />Section 3. That it is hereby determined and declared that said improve-
<br />ment is conducive to the public health, convenience and welfare of said City
<br />and the inhabitants thereof.
<br />Section 4. That the grade of said street as improved shall be the grade
<br />as shown by the plans and profiles which have been prepared by the Ohio De-
<br />partment of Transportation.
<br />Section 5. That the plans, specifications, estimates and profiles of the
<br />proposed improvement, heretofore prepared. by the Ohio Department of Transpor-
<br />tation on file in the office of the Clerk of this Council, are hereby approved.
<br />Section 6. That the cost of constructing concrete sidewalks between the
<br />south corporation line and the I-480 interchange after deducting the amounts
<br />allocated thereto from Federal, State, or County funds, less 2% and the cost
<br />of intersections attributable to the remainder of such costs, shall be assessed
<br />by the foot frontage method of assessment upon. all lots and lands bounding and
<br />abutting upon Relocated S. R. 252, between the south corporation line and the
<br />I-480 interchange, which lots and lands are hereby determined to be specially
<br />benefited by said improvement; and the cost of said improvement shall include
<br />the cost of preliminary and other surveys, plans, specifications, profiles and
<br />estimates and of printing, serving and publishing notices, resolutions and
<br />ordinances, the amount of damage resulting from the improvement assessed in
<br />favor of any owner of land affected by the improvement and the interest there-
<br />on, the costs incurred in connection with the preparation, levy and collection
<br />of the special assessments, the cost of purchasing, appropriating, and other-
<br />wise acquiring therefor any required real estate or interests therein, expenses
<br />of legal services- including obtaining an approving legal opinion, cost of
<br />labor and material, and interest on bonds and notes issued in anticipation of
<br />the levy and collection of the special assessments together with all other
<br />necessary expenditures.
