~_ CITY OF NORTH OLMSTED ORDINANCE N0. 80- 39 BY : ~~ ~y.~~.,r AN ORDINANCE AMENDING THE ZONING CODE OF THE CITY OF NORTH OLMSTED BY ADDING THERETO A NEW SECTION 1174.10 ENTITLED "REGULATIONS REGARDING THE INSTALLATION OF OUTDOOR TELEPHONE PAY STATIONS" OF CHAPTER 114 ENTITLED "HEIGHT AND AREA REGULATIONS FOR RETAIL BUSINESS DISTRICTS". WHEREAS, it has been determined by this Council that in recent years the Ohio Be11 Telephone Company has indiscriminately placed telephone booths in various locations on private property within the side yard and setback area, together with the placing of pay phones on the exterior of various retail business structures, an d WHEREAS, it is the desire of this Council to regulate the installation of pay phones. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That the Zoning Code of the City of North Olmsted be amen~e~to include a new Section 1174.10 to be entitled "Regulations Regarding the Installation of Outdoor Telephone Pay Stations" of Chapter 1174 entitled "Height and Area Regulations for Retail Business Districts", which new section shall read as follows: 1174.01 REGULATIONS REGARDING THE INSTALLATION OF OUTDOOR TELEPHONE PAY STATIONS. For the purposes of this Zoning Code the installation of pay telephones shall be considered to be a permitted use by virtue of 1173.02 (_d)(3) of the Zoning Code, and the following shall constitute the regulations for the installation of pay phones within the City of North Olmsted: (a) No pay phone support structure shall be permitted within the first twenty-five (25) feet of the setback nor shall any pay phone structure be permitted to be constructed closer than five feet (5') from th.e side yard of any lot. (b) There shall be required for each telephone located in the phone support structure a minimum of two (.2) parking spaces per telephone. (.c) No free standing pay phone structure nor any pay phone structure attached to an existing building shall be installed until such time as the applicant has filed the proper application for a building permit, together with a signed and notorized document from the property owner that the applicant has permission to install the aforesaid telephone structure . SECTION 2: That the Clerk. of this Council be and she is hereby erectect-moo cause a notice of a Public Hearing hereon to be given pursuant to the provisions of Section 14 of Article IV of the Charter of this City.
