<br />~_ <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80- 39 <br />BY : ~~ ~y.~~.,r <br />AN ORDINANCE AMENDING THE ZONING CODE OF THE <br />CITY OF NORTH OLMSTED BY ADDING THERETO A NEW <br />SECTION 1174.10 ENTITLED "REGULATIONS REGARDING <br />THE INSTALLATION OF OUTDOOR TELEPHONE PAY <br />STATIONS" OF CHAPTER 114 ENTITLED "HEIGHT AND <br />AREA REGULATIONS FOR RETAIL BUSINESS DISTRICTS". <br />WHEREAS, it has been determined by this Council that in <br />recent years the Ohio Be11 Telephone Company has indiscriminately <br />placed telephone booths in various locations on private property <br />within the side yard and setback area, together with the placing <br />of pay phones on the exterior of various retail business structures, <br />an d <br />WHEREAS, it is the desire of this Council to regulate the <br />installation of pay phones. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Zoning Code of the City of North Olmsted <br />be amen~e~to include a new Section 1174.10 to be entitled "Regulations <br />Regarding the Installation of Outdoor Telephone Pay Stations" of <br />Chapter 1174 entitled "Height and Area Regulations for Retail Business <br />Districts", which new section shall read as follows: <br />1174.01 REGULATIONS REGARDING THE INSTALLATION OF OUTDOOR <br />TELEPHONE PAY STATIONS. <br />For the purposes of this Zoning Code the installation of <br />pay telephones shall be considered to be a permitted use by virtue <br />of 1173.02 (_d)(3) of the Zoning Code, and the following shall <br />constitute the regulations for the installation of pay phones <br />within the City of North Olmsted: <br />(a) No pay phone support structure shall be permitted <br />within the first twenty-five (25) feet of the setback nor shall <br />any pay phone structure be permitted to be constructed closer than <br />five feet (5') from th.e side yard of any lot. <br />(b) There shall be required for each telephone located in <br />the phone support structure a minimum of two (.2) parking spaces <br />per telephone. <br />(.c) No free standing pay phone structure nor any pay phone <br />structure attached to an existing building shall be installed until <br />such time as the applicant has filed the proper application for a <br />building permit, together with a signed and notorized document from <br />the property owner that the applicant has permission to install the <br />aforesaid telephone structure . <br />SECTION 2: That the Clerk. of this Council be and she is <br />hereby erectect-moo cause a notice of a Public Hearing hereon to be <br />given pursuant to the provisions of Section 14 of Article IV of the <br />Charter of this City. <br />
