•~ <br />. ,,~, <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2009 - 8 <br />BY: Mayor O'Grady and Councilman Ryan <br />A RESOLUTION ACCEPTING A GRANT, IF AWARDED, FROM <br />THE OHIO PUBLIC WORKS COMMISSION FOR THE <br />RESURFACING OF DOVER CENTER ROAD AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A PROJECT <br />AGREEMENT WITH THE OHIO PUBLIC WORKS <br />COMMISSION SETTING FORTH THE TERMS AND <br />CONDITIONS OF THE GRANT. <br />WHEREAS, the District One Public Works Integrating Committee (DOPWIC) <br />announced on December 9, 2008 that it will recommend the Dover Center Resurfacing Project <br />from North Olmsted for Ohio Public Works Commission (OPWC) funding in 2009 in the <br />amount of Eight Hundred Nine Thousand, Five Hundred Forty Eight Dollars ($809,548.00) <br />LTIP Grant; and <br />WHEREAS, it is the desire of this Council to accept the grant, if awarded, and <br />authorize the Mayor to enter into a Project Agreement with OPWC providing for the terms <br />and conditions upon which the said grant shall be made to the City; <br />NOW, THEREFORE, BE IT RESOLVED B Y THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City of North Olmsted accepts an OPWC grant, if awarded, in <br />the amount of Eight Hundred Nine Thousand, Five Hundred Forty-Eight Dollars <br />($809,548.00) for the resurfacing of Dover Center Road, and authorizes the Mayor to enter <br />into a Project Agreement with the Ohio Public Works Commission providing for the terms <br />and conditions of the said grant. Said contract shall be in the form and substance of an Ohio <br />Public Works Commission Project Agreement -Local Transportation Improvement Program, <br />with such changes therein as are not substantially adverse to the City. The character of the <br />contract as not being substantially adverse to the City shall be evidenced conclusively by the <br />execution of the agreement by the Mayor and the approval of the agreement by the Director of <br />Law. <br />SECTION 2: That this Resolution shall take effect and be in force from and afte~° the <br />earliest period allowed by law. <br />~-.. <br />``,, <br />PASSED: u 0 ~ G'C~ ~ First Reading.• <br />Second Reading <br />t ~~.
