CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-62 <br />By: MAYOR NORMAN MUSIAL <br />A1V pRDI1VANCE AUTHORIZING AND DIRECTING THE <br />MAYOR TO ENTER INTO AN AGREEMENT WITH <br />BROWNING-FERRIS INDUSTRIES OF OHIO, INC. FOR A <br />TWO YEAR EXTENSION TO THE CONTRACT FOR THE <br />COLLECTION AND DISPOSAL OF SOLID WASTE AND <br />PROCESSING OF RECYCLABLE MATERIALS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted currently has a contract with Brovvning-Ferris <br />Industries of Ohio, Inc. for the collection and disposal of solid waste and the collection and <br />processing of recyclable materials which shall expire December 31, 2001; and <br />WHEREAS, said contract contains a provision permitting the extension of the contract; <br />and <br />WHEREAS, it is the desire of this Council to authorize and direct the Mayor to enter into <br />an agreement providing for a two year extension of the contract with Brovvving-Ferris Industries <br />of Ohio, Inc. ; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be, and, is hereby authorized and directed to enter into an <br />agreement with Browning-Ferris Industries of Ohio, Inc. for a two year extension of the contract <br />for the collection and disposal of solid waste and the collection and processing of recyclable <br />materials. Said agreement is attached hereto and made a part hereof and marked Exhibit "A". <br />The agreement shall provide for the fiunishing of a performance bond for the two-year eatension <br />of services. <br />SECTION Z: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is necessary to authorize the Mayor to enter into the attached agreement in <br />order to expeditiously provide for the collection and disposal of solid waste and the collection <br />and processing of recyclable materials to the City, and provided it receives the affirmative vote <br />of two-thirds of all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor.
