<br />?...- ? <br />QTYOFNORTg OLMSTF.D <br />ORDINANCE NO. 90- 141 <br />BY.• COUNCILMAN GEORGE NASHER <br />AN ORDINANCE CREATING NEW SEGTION 1341.03 OF THE CITY OF <br />NORTH OLMSTED CODIFIED ORDINANCES, EINTITLID 'STREET <br />GLEAIVING DEFOSTI AND FEE, ' AND DECLARING AN EMERGENCY. <br />WHEREAS, the dropping of dirt, mud, clay, sand and other materials upon public <br />streets within the City of North Olmsted by builders, developers, and other persons, poses <br />a serious hazard and risk of injury to the public; and <br />WHEREAS, it is the desire of this Council to enact legislation which would require <br />builders and developers to deposit with the City Engineer sufficient funds to enable the <br />City to clean from the public streets such dropped materials if the builder or developer <br />fails to promptly do so, and to deduct the City's costs in so doing from the monies deposit- <br />ed <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />E TI N 1 That there be, and hereby is, enacted new Section 1341.03 of the City <br />of North Olmsted Codified Ordinances, entitled "Street Cleaning Deposit and Fee," which, <br />as enacted, shall read in its entirety as follows: <br />" 1341.0 STREET CLEANING DEP IT AND FEE <br />(a) Whenever a permit for a new building, or an addition to an <br />existing building, is issued pursuant to Chapter 1321; or a depos- <br />it is made for the inspection of the improvements for a major <br />subdivision pursuant to Section 1101.06, the applicant for such <br />building permit or developer of such subdivision shall pay to the <br />City Engineer a$25.00 fee, plus a deposit of $250.00 for every <br />$100,000 or fraction thereof of the total estimated cost of con- <br />struction. For Building Permits, the estimated cost of construc- <br />tion shall be not less than the value estimated by the Building <br />Commissioner; and for subdivision improvements, the estimat- <br />ed cost of construction shall be not less than the value estimated <br />by the City Engineer. The street cleaning fee and deposit shall <br />be paid to the City Engineer prior to the issuance of a Building <br />Permit and, with respect to a subdivision, prior to the com- <br />mencement of any subdivision improvements, including soil <br />removal. The City Engineer, upon the Building Commissioner's <br />recommendation, may waive the street cleaning deposit for any
