? <br />BY.• MAYOR IDWARD BOYLE <br />0 <br />CIL'Y OF 11OR771 OLMSTF.n <br />ORDINANCE NO. 90-138 <br />AN ORDINANCE PROVIDING FOR A PROCEDURE TO <br />IMPLEMENT A JOINT PURCHASING PROGRAM IN <br />COOPERATION WITH THE WESTSHORE COUNCIL OF <br />GOVERNMENTS, AND DECLARING AN EMERGENCY. <br />WHEREAS, by Charter provision, Section 6 of Article VIII, the City is generally <br />permitted to expend funds without public bidding for goods and services in an amount not <br />exceeding Ten Thousand Dollars ($10,000.00); and <br />WHEREAS, by virtue of the aforesaid section, general expenditures in excess of <br />Ten Thousand Dollars ($10,000.00) require public bidding and final approval of the Board <br />of Control before said amount may be expended; and <br />WHEREAS, contained in Article VIII, Section 6 of the Charter is an exception to <br />public bidding by the City when purchases of goods or services consist of the "...exercise of <br />power with other political subdivision..."; and <br />WYLEREAS, in order to benefit in a program of quantity buying at a lower cost it is <br />the desire of this City to participate in the Westshore Council of Governments Purchasing <br />Program. <br />NOW, THEREFORE, BE IT ORDAINID BY 771E COUNCIL OF TlIE CTIY OF <br />NORTH OLMSTID, CUYAHOGA COUNTYAND STATE OF OHIO: <br />SEGTION 1: That this Council does hereby establish and authorize the administra- <br />tion to participate in a purchasing program with the Westshore Council of Governments <br />whereby the Westshore Council of Governments shall issue invitations to bid which sha11 <br />be in accordance with bid documents and specifications as determined by the properly <br />designated official of said Council of Governments. The subject of the invitation to bid <br />may be any goods or services which the City is permitted to purchase on its own. <br />SEC170N 2: That whenever it is determined that the City requires goods, materi- <br />als or services, the estimated cost of which exceeds the amount specified in Section 6 of <br />Article VIII of the Charter requiring public bidding, the Director of Public Service shall <br />present said request to the Board of Control. In presenting said request, said director <br />shall satisfy the Board of Control that funds have been appropriated for said goods, mate- <br />rial or services and that the purchase of same can be accomplished at a lesser price udliz- <br />ing the purchase services of the Council of Government. If by a majority vote of the Board <br />of Control, it is determined that it is in the best interest of the City to utilize the purchas- <br />ing services of the Council of Governments, the appropriate director shall make applica- <br />tion to the Council of Governments for the subject goods, material or services. Such an <br />application shall constitute an agreement to bind the City of North Olmsted with respect <br />to the conditions of the Westshore Council of Governments in the collective procurement
