<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 9 0 -115 <br />BY: THE ENTIRE COUNCIL <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELEC- <br />TORS OF THE CITY OF NORTH OLMSTED, OHIO OF AN AMENDMENT <br />TO ARTICLE VI, SECTION 6 OF THE CHARTER PROVIDING FOR <br />THE PROCEDURE FOR SUSPENSION AND REMOVAL OF rEMBERS OF <br />THE CIVIL SERVICE COMMISSION AS RECONIMENDED BY THE <br />CHARTER REVIEW COMMISSION, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Charter Review Commission of the City of North Olmsted, <br />appointed pursuant to Article XIV of the Charter of the City of North <br />Olmsted, has filed its report of recommended amendments to the Charter with <br />this Council, and <br />WHEREAS, this Council deems it appropriate to submit the within pro- <br />posal to the electors for their consideration at the General Election to be <br />held within the City on November 6, 1990. <br />NOW, THEREFORE, $E IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO, TWO-THIRDS OF ALL MEMBERS <br />CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs the sub- <br />mission to the electors of the City of North Olmsted at the General Elec- <br />tion to be held at the usual places of voting in said City on Tuesday, <br />November 6, 1990, the following separate proposal to amend the Charter of <br />the City of North Olmsted: <br />Proposal: That Article VI Section 6 of the Charter relating to the <br />removal of a Civil Service Commission member be amended to provide for a <br />procedure to suspend and remove a Civil Service Commission member for cause <br />with the concurrence of two-thirds (2/3) of the members of Council. Such <br />proposed amended Section 6 of Article VI shall read as follows; <br />Article VI <br />The Civil Service Commission <br />SECTION 6. REMOVAL OF COMMISSIONER. <br />The Mayor may at any time remove any Commissioner for inef- <br />ficiency, neglect of duty, malfeasance, misfeasance, or nonfea- <br />sance in office, incapacitp or incompetencp. Said removal shall <br />not become final without the concurrence of two-thirds (2/3) of <br />the members of Council. From the time when the Mapor notifies a <br />Commissioner of his removal, said Commissioner shall be suspended <br />pending the outcome of the necessary concurrence of Council. <br />1
