BY: Councilman Tallon <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 90-106 <br />?..+. <br />AN ORDINANCE AUTHORIZING CERTA7N SEWER IMPROVEMENTS <br />NECESSARY TO ABATE EXISTING DETRTMENTAL CONDITIONS <br />AS PUBLIC NUISANCES, TO ASSIST THE CITY IN <br />COMPLYING WITH ENVIRONMENTAL PROTECTION AGENCY <br />REQUIREMENTS RELATING TO INFLOW AND INFILTRATION OF <br />STORM WATER INTO THE CITY'S SANITARY SEWER SYSTEM <br />AND TO PROMOTE THE EFFECTIVE AND EFFICIENT <br />OPERATION OF THAT SYSTEM; AND APPROPRIATING MONEY <br />IN THE SEWER REVENUE FUND FOR THAT PURPOSE. <br />WHEREAS, pursuant to authority <br />and Article XVIII, Section 4 of the <br />operates a sanitary sewer system (the <br />water collec:tion and treat.ment services <br />for certain adjacent areas in the City <br />and the inhabitants of those areas; and <br />provided in Article XVIII, Section 3 <br />Ohio Constitution, the City owns and <br />5ystem), which provides sanitary waste- <br />for the City and its inhabit.ants and <br />of Fairview Park and Olmsted Township <br />WHEREAS, the City has experienced at times of heavy precipitation <br />significant inflow and inf.iltration of storm water into certain sanitary sewer <br />collect.ion facilities of the System, resulting in an overloading of the System <br />and sanitat•y wastewater backups, bypasses and overflows; and <br />WfiER.EAS, as a consequence of the threat to the pubiic health, safety <br />and we7fare presented by such backups, bypasses and overflows, the City has <br />agreed to certain findings and orders of the Director of the Otiio <br />Fnvironmental Protection Agency requiring the City to decrease the amounts of <br />inflow and infiltration into the System to levels consistent with requirements <br />of the United States Environmental Protection Agency and the Ohio <br />Environmental Protection Agency (EPA requirements); and <br />WHEREAS, consistent with those findings and orders and conditions of <br />t.he grant received by the City from the United States Environmental Protection <br />Agency for ttie improvement and expansion of its wastewater treatment plant, <br />the City has undertaken and is undertaking to improve the System by the <br />reliabilitation and reconstruction of sanitary sewers, sanitary sewer connec- <br />tions, pump stations, manholes and necessary appurtenances thereto in City <br />street and easements to meet the EPA requirements; and <br />WHEREAS, based on information and advice from the City's engineering <br />consultants, tliis Council has determined that a substantial portion of the <br />inflow and infiltration of storm water into the System is caused by deteri- <br />orated private laterai sewers tributary to the System and may be caused by <br />roof downspouts, exterior foundation drains, runaway drains or other <br />collectors of storm water, surface runoff or ground water which may be con- <br />nected to building drains which in turn are connected to the private lateral <br />sewers tributary to the System or connected directly to the System contrary to <br />the provisions of Sections 911.07(j) and 911.12(a) of the City's Codified <br />Ordinances; and
