<br />CITY OF NORTH OLMSTSD <br />ORDINALvCE HO. 90- 66 <br />BY : MAYOR EDWARD BOYLE <br />AN ORDINANCE AMENDING CHAPTER 521 OF THE CODIFIED ORDINANCES <br />OF THE CITY OF NORTH OLMSTED ENTITLED "HEALTH, SAFETY AND <br />SANITATION", BY ADDING THERETO A NEW SECTION 521.13 EN2ITLED <br />"VTSUAL OBSTRUCTIONS OF RIGHT-OF-WAY", AND DECLARING AN IIERGENCY <br />WHEREAS, it has come to the attention of this Council that there are <br />currently being maintained within the City on certain private property <br />close to the right-of way of various streets, obstructions which prohibit <br />clear view for pedestrians and vehicles wishing to enter either the side- <br />walk or the paved portion of the street; and <br />WHEREAS, this Council deems it to be a nuisance to maintain such <br />conditions which adversely impact upon both life and property; and <br />WHEREAS, in order to correct the conditions that are being maintained <br />which are adverse to the public health, safety and welfare, it is the <br />desire of this Council to adopt the within ordinance to prohibit such <br />activity. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby created a new Section 521.13 of <br />Chapter 521 entitled "Health, Safetp and Sanitation", which new Section <br />shall be entitled "Visual Obstructions of the Right-of-Way", which shall <br />read as follows: <br />521.13 VISUAL OBSTRUCTIONS OF THE RIGHT-OF-WAY. <br />(a) No person, being the owner of occupant of property within <br />the City shall maintain, cauge to be maintained, place or cause <br />to be placed any vehicle, merchandise, sign, hedge, tree, shrub <br />or other object on private property so as to cause the same to <br />obstruct or unreasonably impair the view of any person doing <br />either of the following: (1) Legally using the public side- <br />walk or roadway; (2) Attempting to legally enter onto a public <br />sidewalk or roadway from private property. <br />(b) Whoever violates this section shall be guilty of a misde- <br />meanor of the fourth degree. Any such violation shall consti- <br />tute a separate offense on each successive day continued.
